3. considère que le football a souffert de l'absence d'un cadre juridique clair, stable et prévisible; note de surcroît que le sport doit faire face à de nombreux contentieux portant sur la légalité de ses structures et de ses règles, qui sont de nature à remettre en cause l'organisation même du modèle sportif européen; invite par conséquent la Commission, les États membres et les autorités du football à définir en étroite concertation un cadre juridique approprié à la lumière du Rapport Indépendant sur le Sport Européen (2006) afin d'éviter de nouveaux contentieux et que la Cour de justice ne détermine l'avenir du football professionnel en Europe; recommande que le cadre soit axé sur la prise en compte de la spécificité du sport et des principes nécessaires à la sauvegarde de l'équité, de la solidarité et de la fonction éducative, ainsi que la mise en place de règles harmonisées assurant la saine concurrence entre les différents clubs européens et permettant une égalité des chances dans les compétitions; affirme cependant que l'approche du football professionnel ne doit pas être uniquement juridique et financière et que sa dimension sociale et éducative est tout aussi importante;

Considers that football has suffered from the absence of a clear, stable and predictable legal framework; notes, moreover, that sport is having to deal with a number of disputes, bearing on the legality of its structures and rules, which are likely to cast doubt on the very organisation of the European sports model; therefore calls on the Commission, the Member States and the football authorities to define, in close consultation, an appropriate legal framework in the light of the Independent European Sport Review 2006, so as to prevent further disputes and ensure that the Court of Justice does not determine the future of professional football in Europe; recommends that the framework take as its basis the recognition of the specific nature of sport and of the principles necessary to safeguard fairness and solidarity, and its educative function, and the implementation of harmonised rules guaranteeing healthy competition between European clubs and a level playing field; takes the view, however, that the approach to professional football should not be governed by legal and financial considerations alone; the social and educational dimensions are also important;

23. invite la Commission, après consultation des instances dirigeantes du football, des ligues et des clubs, à réfléchir à l'introduction d'un statut juridique européen pour les sociétés sportives afin de prendre en compte les activités économiques des grands clubs de football tout en préservant leurs spécificités sportives, lequel statut permettrait la mise en place de règles de contrôle des activités économiques et financières de ces sociétés, ainsi que de formes d'engagement des supporteurs et de participation de la population locale;
23. Calls on the Commission to reflect, in consultation with football governing bodies, leagues and clubs, on the introduction of a European legal status for sports companies to take account of the economic activities of major football clubs whilst preserving their specific sports-related characteristics; such a status would make it possible to establish rules for monitoring the economic and financial activities of such companies and for the involvement of supporters and community participation;

This footballer brought an action before a Belgian court in August 1990 (see attached background file) and managed to persuade the Juge des Référés in Liège to refer the matter to the Court of Justice of the European Communities, on the basis of Article 48 of the Treaty of Rome (free movement of workers), for a preliminary ruling on whether a transfer fee requirement is compatible with Community law in the case of professional footballers who have reached the end of their contract.
