TRADUCTIONS EN CONTEXTE

Le règlement (UE) no 269/2014 du Conseil donne effet à certaines mesures prévues par la décision 2014/145/PESC et prévoit le gel des fonds et des ressources économiques des personnes physiques responsables d'actions ou de politiques compromettant ou menaçant l'intégrité territoriale, la souveraineté et l'indépendance de l'Ukraine, ou la stabilité ou la sécurité de l'Ukraine, qui soutiennent activement ou mènent de telles actions ou politiques ou qui font obstruction à l'action des organisations internationales en Ukraine, ainsi que des personnes physiques ou morales, entités ou organismes qui leur sont associés, des personnes morales, entités ou organismes qui soutiennent matériellement ou financièrement des actions qui compromettent ou menacent l'intégrité territoriale, la souveraineté et l'indépendance de l'Ukraine, des personnes morales, entités ou organismes en Crimée ou à Sébastopol dont la propriété a été transférée en violation du droit ukrainien, ou des personnes morales, entités ou organismes qui ont bénéficié d'un tel transfert; ou à des personnes physiques ou morales, des entités ou des organismes qui apportent un soutien matériel ou financier actif aux décideurs russes responsables de l'annexation de la Crimée ou de la déstabilisation de l'est de l'Ukraine, ou qui tirent avantage de ces décideurs.
Council Regulation (EU) No 269/2014 gives effect to certain measures provided for in Decision 2014/145/CFSP and provides for the freezing of funds and economic resources of natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine, or stability or security in Ukraine or which obstruct the work of international organisations in Ukraine, and natural or legal persons, entities or bodies associated with them; legal persons, entities or bodies supporting, materially or financially, actions which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine; legal persons, entities or bodies in Crimea or Sevastopol whose ownership has been transferred contrary to Ukrainian law, or legal persons, entities or bodies which have benefitted from such a transfer; or natural or legal persons, entities or bodies actively supporting, materially or financially, or benefitting from, Russian decision-makers responsible for the annexation of Crimea or the destabilisation of Eastern Ukraine.

19. observe que l'accès à la justice dans ce domaine est limité par plusieurs facteurs, parmi lesquels la durée ou le coût des procédures, les difficultés rencontrées par les organismes de promotion de l'égalité dans certains États membres, le manque de transparence salariale, l'absence d'aide juridictionnelle gratuite et la crainte de la stigmatisation ou des représailles au cas où les victimes feraient connaître leur vérité concernant la discrimination dont elles font l'objet sur le lieu de travail; souligne que l'application des règles relatives à la charge de la preuve soulève également des difficultés dans plusieurs États membres, ce qui restreint les possibilités de défense des travailleuses qui, bien souvent, n'ont pas accès ou ont un accès limité aux informations ad hoc et craignent en outre de perdre leur emploi; invite les États membres ainsi que les autorités locales et régionales à endosser un rôle actif dans la fourniture d'une assistance aux victimes de discrimination, soit directement soit en soutenant des organismes de promotion de l'égalité, des syndicats, des organisations communautaires ou des ONG actives dans ce domaine; observe qu'une bonne solution pour améliorer l'accès à la justice consisterait à donner à des organismes de promotion de l'égalité indépendants le pouvoir d'apporter une aide aux victimes de discrimination, dont une assistance juridictionnelle gratuite, ainsi que le droit de représenter des personnes dans des affaires de discrimination salariale; suggère en ce sens de mettre en place dans les États membres des mécanismes confidentiels de plainte permettant aux femmes de dénoncer des cas possibles d'inégalité de traitement au travail;
19. Points out that access to justice in this field is limited due to several causes, such as the length or costs of the procedures, the challenges faced by equality bodies in some Member States, the lack of wage transparency, the absence of free legal aid, the fear of stigmatisation or suffering reprisals should victims speak out about discrimination in the workplace; underlines the fact that the application of the burden of proof rule also poses problems in several Member States, thus making the defence of women workers difficult since they often have no access or only limited access to the relevant information and, moreover, fear losing their job; calls on the Member States and regional and local authorities to take an active role in providing assistance to victims of discrimination, either directly or through support for equality bodies, trade unions, community organisations and NGOs working in this field; points out that a relevant solution for improving access to justice in this field would be to give independent equality bodies the power to provide assistance to victims of discrimination, including free legal aid, as well as the right to represent individuals in cases of pay discrimination; suggests in this regard that confidential reporting systems be introduced in the Member States to enable women to report possible instances of inequality of treatment in the workplace;

(33) Afin de clarifier le régime des exemptions en ce qui concerne le système européen des banques centrales (SEBC) , les autres organismes nationaux à vocation similaire et les organismes intervenant dans la gestion de la dette publique, il convient de limiter ces exemptions aux organismes et institutions qui exercent leurs fonctions conformément au droit d'un État membre ou au droit de l'Union ainsi qu'aux organismes internationaux dont font partie deux ou plusieurs États membres et qui ont pour finalité de mobiliser des fonds et d'apporter une aide financière à ceux de leurs membres qui connaissent des difficultés financières graves ou risquent d'y être exposés, par exemple le mécanisme européen de stabilité .
(33) In order to clarify the regime of exemptions for the European System of Central Banks (ESCB), other national bodies performing similar functions and bodies intervening in the management of public debt, it is appropriate to limit such exemptions to the bodies and institutions performing their functions in accordance with the law of one Member State or in accordance with the Union law, as well as to international bodies of which two or more Member States are members and which have the purpose of mobilising funding and providing financial assistance to the benefit of their members that are experiencing or threatened by severe financing problems, such as the European Stability Mechanism .

3. Where a collective management organisation mandates another collective management organisation to grant multi-territorial licences for the online rights in musical works under Articles 29 and 30, the mandated collective management organisation shall also apply paragraph 2 of this Article with respect to the rightholders whose musical works are included in the repertoire of the mandating collective management organisation, unless the collective management organisations agree otherwise.

22. Follows the Council in its decisions to moderate the increase of subsidies to the decentralised agencies; decides to put 50 % of the appropriations in the reserve for those agencies for which a solution on the location and effective operation is pending; welcomes the priorities of budgetary transparency in the new Financial Regulation due to enter into force on 1 January 2003 while underlining the Council's and Commission's inconsistency to request new tasks from the agencies without additional funding; is willing to give more visibility to the cost of the preparation of enlargement within each agency's budget in view of the calculation of the new FP for the enlarged Union;
