3. Si, malgré les mesures prises par l'autorité compétente de l'État membre d'origine ou parce que celle-ci ne réagit pas dans un délai raisonnable, le gestionnaire du fonds de capital-risque éligible continue d'agir d'une manière qui est clairement incompatible avec le présent règlement, l'autorité compétente de l'État membre d'accueil peut, après en avoir informé l'autorité compétente de l'État membre d'origine, prendre toutes les mesures appropriées pour protéger les investisseurs, y compris l'interdiction au gestionnaire de fonds de capital-risque éligibles de continuer à commercialiser ses fonds de capital-risque éligibles sur le territoire de l'État membre d'accueil.
3. If the manager of a qualifying venture capital fund persists in acting in a manner that is clearly in breach of this Regulation despite measures taken by the competent authority of the home Member State or because that competent authority has failed to take measures within reasonable time, the competent authority of the host Member State may, after informing the competent authority of the home Member State, take all the appropriate measures in order to protect investors, including prohibiting the manager of a qualifying venture capital fund from carrying out any further marketing of its qualifying venture capital funds within the territory of the host Member State.

2. La délégation de fonctions prévue au paragraphe 1 ne porte pas atteinte au bon exercice de la surveillance dont le gestionnaire de fonds de capital-risque éligibles fait l'objet et, en particulier, n'empêche pas ledit gestionnaire d'agir, ni le fonds de capital-risque éligible d'être géré, au mieux des intérêts des investisseurs dans ce fonds.
2. Any delegation of functions under paragraph 1 shall not undermine the effectiveness of supervision of the manager of a qualifying venture capital fund, and, in particular, shall not prevent that manager from acting, or the qualifying venture capital fund from being managed, in the best interests of the investors therein.
