Au sein de l'EVN, l'Institut conjoint pour l'interférométrie à très longue base en Europe (JIVE) a été mis en place en 1993 sous la forme d'une entité juridique de droit néerlandais (stitchting/fondation) pour la prestation de services centraux et en particulier le traitement des données (corrélation) recueillies par télescope.

Does European Union law, and in particular Article 31(3) of the Third Life Assurance Directive, (1) preclude an obligation on the part of a life assurance provider on the basis of the ‘open’ and/or unwritten rules of Netherlands law — such as the reasonableness and fairness which govern the (pre-)contractual relationship between a life assurance provider and a prospective policyholder, and/or a general and/or specific duty of care — to provide policyholders with more information on costs and risk premiums of the insurance than was prescribed in 1999 by the provisions of Netherlands law by which the Third Life Assurance Directive was implemented (in particular, Article 12(2)(q) and (r) of the RIAV [(Netherlands Regulation regarding the provision of information to policyholders)] 1998)?

An in-house lawyer enrolled at a Bar or Law Society is, simply on account of his obligations of professional conduct and discipline, just as independent as an external lawyer. Furthermore, the guarantees of independence enjoyed by an ‘advocaat in dienstbetrekking’, that is an enrolled lawyer in an employment relationship under Dutch law, are particularly significant.

Notwithstanding the professional regime applicable in the present case in accordance with the specific provisions of Dutch law, an in-house lawyer cannot, whatever guarantees he has in the exercise of his profession, be treated in the same way as an external lawyer, because he occupies the position of an employee which, by its very nature, does not allow him to ignore the commercial strategies pursued by his employer, and thereby affects his ability to exercise professional independence.

S’agissant des règles professionnelles invoquées par les parties requérantes afin de démontrer l’indépendance de M. S., il convient d’observer que, s’il est vrai que les règles d’organisation professionnelle en droit néerlandais évoquées par Akzo et Akcros sont susceptibles de renforcer la position de l’avocat interne au sein de l’entreprise, il n’en demeure pas moins qu’elles ne sont pas aptes à assurer une indépendance comparable à celle d’un avocat externe.
As regards the professional ethical obligations relied on by the appellants in order to demonstrate Mr S’. s independence, it must be observed that, while the rules of professional organisation in Dutch law mentioned by Akzo and Akcros may strengthen the position of an in-house lawyer within the company, the fact remains that they are not able to ensure a degree of independence comparable to that of an external lawyer.
