L'Agence évalue les résultats des opérations conjointes et des projets pilotes et transmet les rapports d'évaluation détaillés au conseil d'administration dans les soixante jours suivant la fin de ces opérations et de ces projets, accompagnés des observations de l'officier aux droits fondamentaux visé à l'article 26 bis. L'Agence établit une analyse comparative globale de ces résultats afin d'améliorer la qualité, la cohérence et l'efficacité des opérations conjointes et des projets pilotes futurs et l'intègre dans son rapport général visé à l'article 20, paragraphe 2, point b).
3. The Agency shall evaluate the results of the joint operations and pilot projects and transmit the detailed evaluation reports within 60 days following the end of those operations and projects to the Management Board, together with the observations of the Fundamental Rights Officer referred to in Article 26a. The Agency shall make a comprehensive comparative analysis of those results with a view to enhancing the quality, coherence and effectiveness of future joint operations and pilot projects and include it in its general report provided for in point (b) of Article 20(2).

This Directive is based on Court of Justice case-law, in particular case-law on award criteria, which clarifies the possibilities for the contracting entities to meet the needs of the public concerned, including in the environmental and/or social area, provided that such criteria are linked to the subject-matter of the contract, do not confer an unrestricted freedom of choice on the contracting entity, are expressly mentioned and comply with the fundamental principles mentioned in recital 9.
