Recognises that immigration policy has become a priority on the EU's internal and external policy agenda and that in its texts the EU has been attempting to link immigration and development and to ensure that the fundamental rights of immigrants are respected; maintains, however, that the reality on the ground belies those texts; stresses that agreements for the readmission of illegal immigrants must be concluded with countries having the legal and institutional machinery needed in order to handle the readmission of their nationals and protect their rights; stresses the need to ensure that the implementation of such readmission agreements fully respects the principle of non-refoulement, and to ensure access to a fair asylum procedure; calls for effective monitoring of the treatment of persons returned under readmission agreements, in particular with regard to possible ‘chain refoulement’;

Notes the creation of a new ‘Justice, Fundamental Rights and Citizenship’ portfolio within the Commission as an indication of its commitment to step up its efforts in the area of fundamental rights and freedoms and as a positive response to Parliament’s repeated requests in this regard; such a division between justice and security should not reinforce the misconceived dichotomy between the need to protect the human rights of all people and the need to guarantee their security; the new Commissioner should pay particular attention to EU policies on fighting irregular migration and terrorism, and the full support of the College of Commissioners is crucial to enable the new Commissioner to maintain a high profile;

- Support the development of specific integration programmes for newly arrived immigrants; including facilitation of acquisition of language skills and emphasizing practical inter-cultural skills needed for effective adaptation as well as the commitment to fundamental European values; this could be further explored by identifying the basic rights and obligations for newly arrived immigrants, in the framework of specific national procedures (e.g. integration curricula, explicit integration commitments, welcoming programmes, national plans for citizenship and integration, civic introduction or orientation courses);

As announced in the Policy Plan on Legal Migration[11], Commission proposals for a general framework directive defining the basic rights of immigrant workers in the EU and for a directive on the conditions of entry and residence of highly skilled immigrants are forthcoming[12].

6. L’approche globale de l’UE en matière de lutte contre l’immigration clandestine suit une série de principes fondamentaux visant à concilier le besoin de solidarité au sein de l’Union, les droits fondamentaux, les attentes des pays tiers et l’opinion publique dans les États membres.
6. The comprehensive EU approach to combat illegal immigration is guided by a set of fundamental principles which aim to reconcile the need for solidarity within the Union, fundamental rights, expectations of third countries, and public perception in Member States.

- Parmi les recommandations des experts, il faudrait rappeler en particulier : * l'invitation à élaborer un socle de principes fondamentaux sur l'intégration des migrants; une telle démarche permettrait de repérer les convergences des diverses logiques nationales et serait l'occasion de trouver des rapprochements là où les divergences sont explicites; * la nécessité d'accentuer la prise en compte des migrations dans les accords et les relations entre la Communauté et les Etats tiers qui connaissent des flux d'émigration doublés d'une forte poussée démographique; * l'invitation à continuer et approfondir la concertation entre Etats membres et institutions communautaires sur les questions de l'immigration et de l'intégration.
- The experts particularly recommend: * that a body of basic principles be worked out for immigrant integration; this would help in finding common ground between differing national rationales and would serve to discover ways and means of eliminating obvious disparities; * that more careful consideration be given to migration in agreements and relations between the Community and countries where a tide of emigration is being compounded by a population explosion; * that the Member States and the Community institutions continue and strengthen their concentration on the problems of immigration and integration.

Pour ces derniers, notamment, dans le cadre des actions et des initiatives menées avec le soutien de la Communauté, une différence de traitement basée sur la nationalité du jeune élève ou travailleur ne favoriserait pas une démarche d'intégration. c) En matière d'éducation, il faut souligner l'importance de l'éducation interculturelle comme stratégie éducative d'ensemble, susceptible à la fois de promouvoir l'intégration des enfants issus de la migration et de contribuer à la lutte contre la formation de préjugés raciaux ou xénophobes. d) L'élaboration d'un socle de principes fondamentaux sur l'intégration des migrants, bien que n'ayant pas un caractère contraignant, pourrait constituer une démarche utile à une approche "communautaire" de l'intégration, compte tenu des convergences existant entre les Etats membres à l'égard des questions posées et des actions envisagées ou mises en oeuvre. e) Une coopération accrue à l'intérieur de la Communauté sur les questions des migrations internationales et d'intégration des immigrés paraît s'imposer d'elle-même, en vue, entre autre, des incidences de toute décision nationale dans ce domaine sur l'ensemble du marché du travail de la Communauté, sur la cohésion sociale de cette dernière et sur son image d'une Communauté qui affiche et défend des valeurs démocratiques et de solidarité.
For migrants, in particular, with the measures and initiatives implemented with Community support, any difference in treatment based on a child's or worker's nationality would do nothing for the integration process (c) In education the emphasis should be on the importance of intercultural instruction as an overall teaching strategy which can both further the integration of migrants' children and help to combat racial prejudice or xenophobia (d) A body of basic principles, even if not binding, could be helpful steeping stone towards a "Community" approach to integration in the light of the existing common ground between the Member States as regards the issues raised and measures planned or implemented (e) The need for closer cooperation within the Community on matters of international migration and immigrant integration is self-evident, when any national decision on these issues can affect the whole Community market, the Community's social cohesion and its image as a "Community" that professes to champion the values of democracy and solidarity.

The extent and development of such a cooperation will depend on Libya's commitments on asylum and fundamental rights as stated above; invites the Commission to engage, on the basis of the suggestions contained in the Annex and as soon as possible, in exploratory discussions with the Libyan authorities to identify practical measures to tackle illegal migration in areas such as training, reinforcement of institution building, asylum issues and increasing public awareness of the dangers of illegal migration, and to discuss the conditions under which such cooperation could take place; invites the Commission to report on the outcome of its exploratory discussions with the Libyan authorities in order for the Council to consider further action; stresses that as long as Libya does not fully integrate into the Barcelona process, any cooperation with Libya can only be limited in scope and take place on a technical ad hoc basis; calls upon the Commission to extend this cooperation to the main countries of origin and transit on the African continent in close relation with the relevant regional organisations to develop a wider approach to migration management on the African continent; calls upon the Member States and the Commission to implement swiftly the measures listed in the Annex, and calls upon the Member States to intensify, in particular in the framework of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union (the "Agency"), their cooperation on maritime external borders in the Mediterranean area and invites the Agency to include among its priorities in the working programme for 2005 and 2006 concrete operational actions on this issue; invites the Commission to provide regular reports on progress in cooperation with the main African countries of origin and transit and in the implementation of the measures to intensify cooperation within the EU.
