La création d'un marché européen ouvert pour les chercheurs passe notamment par une véritable ouverture des postes des secteurs publics nationaux aux chercheurs de l'UE et des pays tiers, une exigence que la Commission européenne a déjà formulée explicitement [71]: « Toutes les (...) procédures de recrutement doivent être ouvertes [72] (...) En outre, les États membres ne sont pas autorisés à refuser aux travailleurs migrants le statut de fonctionnaire, s'il y a lieu, lorsque ceux-ci ont été admis dans le secteur public.
One of the elements for the establishment of an European open market for researchers is linked to the real and effective opening up of national public sector positions to EU and third country researchers which has already been made explicit by the European Commission [71]: "All (...) recruitment procedures have to be open [72] (...) We are currently completing an impact assessment of the various possible approaches to resolving the problem that I just mentioned, including national inspection and mandatory national risk assessment plans and programmes, as well as more targeted training for national officials responsible for enforcing the provisions and, on the other side of the coin, for proving that those who declare waste to be second-hand goods are doing so fraudulently.

Sans préjudice des audits réalisés par la Cour des comptes en liaison avec les organismes ou services nationaux d'audit compétents, conformément à l'article 287 du traité, ou de toute inspection menée en vertu de l'article 322, paragraphe 1, point b), du traité, les fonctionnaires ou autres agents de la Commission effectuent des contrôles sur place, notamment par sondage, sur les projets et autres mesures financés au titre du programme, notamment afin de vérifier leur conformité avec les objectifs du programme et l'admissibilité des actions conformément aux dispositions des articles 2, 3 et 4 du présent règlement.

Without prejudice to the audits carried out by the Court of Auditors in liaison with the competent national audit bodies or departments pursuant to Article 287 of the Treaty, or any inspection carried out pursuant to Article 322(1)(b) of the Treaty, officials and other staff of the Commission shall carry out on-the-spot checks, including sample checks on projects and other measures financed under the Programme in particular to check compliance with the objectives of the Programme and the eligibility of actions as set out in Article 2, 3 and 4 of this Regulation.

C’est la raison pour laquelle mon rapport formule plusieurs propositions concrètes à l’intention de la Commission, inspirées notamment de la conférence organisée avec les ONG concernées et du dialogue intensif mené avec vos fonctionnaires nationaux.
That is why a number of specific proposals are being submitted to the Commission in my report, partly on the basis of the conference with the NGOs involved and intensive talks with your official services.

Il faut donc combattre tout ce qui contribue à faire de la Commission une forteresse opaque au contrôle et notamment : redonner au Conseil un véritable contrôle politique sur la Commission ; renforcer la coopération dans les deux sens entre la Cour des comptes européenne et les cours nationales, afin d'améliorer les contrôles à la fois dans les États et à Bruxelles ; supprimer les privilèges quasi diplomatiques dont bénéficie la Commission et qui entravent les enquêtes ; ouvrir beaucoup plus la fonction publique européenne à des fonctionnaires nationaux spécialisés en détachement temporaire ; enfin, comme l'a proposé notre commission de l’emploi et des affaires sociales, dans un avis qui n'a pas été suivi d'effet, revoir complètement la possibilité de financer des groupes d'intérêts, sans autorisation préalable, sur la partie A du budget, possibilité qui ouvre aujourd'hui la porte à la distribution de subventions sans base légale et favorise le clientélisme autour de la Commission.
We must therefore fight against everything which may help to make the Commission into an uncontrollable fortress. In particular, the Council must be given back proper political control over the Commission. Cooperation in both directions between the Court of Auditors and the national courts must be reinforced in order to improve the controls in both the Member States and Brussels. The quasi-diplomatic privileges of the Commission must be removed as these hinder investigations. The European civil service must be opened up much more to specialist national officials on temporary secondment. Finally, as proposed by our Committee on Employment and Social Affairs, in an opinion which has been ignored, the possibility of financing interest groups, without prior authorisation, in part A of the budget must be completely reviewed. This currently allows the distribution of subsidies without any legal basis and encourages cronyism around the Commission.

La décision 87/373/CEE s"est efforcée de réglementer les procédures de "comitologie" aux termes desquelles les compétences d"exécution conférées à la Commission par la législation de l"Union sont soumises à certaines exigences, notamment à un contrôle de la part de comités de fonctionnaires nationaux. Decision 87/373/EEC has tried to regulate the so-called "commitology" procedures, by which the implementing powers conferred on the Commission by Union legislation are submitted to certain requirements, in particular scrutiny by committees of national civil servants; the different procedures can be summarised in the following manner:

Ces changements visent notamment à : faire du conseil de discipline un organe permanent et plus professionnel, présidé par un spécialiste extérieur à la Commission ; améliorer les dispositions qui régissent la suspension motivée de fonctionnaires, y compris ceux qui sont poursuivis au pénal par des tribunaux nationaux ; consolider l'indispensable coordination entre la Commission et l'OLAF sans pour autant compromettre l'indépendance essentielle de l'OLAF ; affiner la liste des sanctions possibles afin qu'elles correspondent mieux à tout manquement avéré au statut des fonctionnaires.
They include: making the disciplinary board a permanent and more professional body, chaired by a qualified specialist from outside the Commission; improving the provisions governing the justified suspension of officials, including those being prosecuted in criminal cases in national courts; consolidating the vital coordination between the Commission and OLAF whilst not compromising the essential independence of OLAF; refining the list of possible sanctions to relate them better to any proven contravention of staff regulations.
