Notes that in one of the cases referred to in paragraph 5, the European Union Civil Service Tribunal decided in favour of the applicant (Case F-58/10, judgment of 18 September 2012) and annulled the Agency's decision of 16 October 2009 not to bring disciplinary proceedings against two members of staff for alleged psychological harassment due to the lack of impartiality on the part of the investigator and his refusal to guarantee the anonymity of the witnesses and ordered it to pay damages to the applicant and the costs; notes that in case F-112/10, the Tribunal decided in favour of the Agency but the applicant brought an appeal before the General Court against the judgment; notes that judgement is pending in case F-38/12;

En tout état de cause, il convient de rappeler la jurisprudence bien établie selon laquelle le règlement n 1049/2001 constitue une norme de caractère général qui détermine les principes généraux régissant l’exercice du droit de tout citoyen de l’Union d’accéder aux documents des institutions concernées dans tous les domaines d’activité de l’Union, y compris dans celui de la fonction publique (arrêt du Tribunal de première instance du 17 mai 2006, Kallianos/Commission, T-93/04, point 87).
In any event, it is appropriate to recall the settled case-law according to which Regulation No 1049/2001 constitutes a general rule which determines the general principles governing the exercise of the right of any citizen of the Union to have access to documents of the institutions concerned in all areas of the Union’s activity, including that of the civil service (judgment of 17 May 2006 in Case T-93/04 Kallianos v Commission, paragraph 87).

Temporary Judges will be chosen from a list of three former Members of the Court of Justice drawn up by the Council on a proposal from the President of the Court of Justice. The temporary Judge shall serve only as long as the Judge he is replacing, is hindered to be in office. The Court argues that this arrangement is flexible and guarantees that the Judges concerned are operational as soon as they are designated. It would also apply to other Specialised Courts established pursuant to Article 257 TFEU (up to now there is only the European Union Civil Service Tribunal).

Il en découle que, malgré les différences existant entre le règlement de procédure du Tribunal et celui du Tribunal de la fonction publique, il demeure possible à ce dernier de suivre la même procédure que celle suivie par le Tribunal, selon laquelle, lorsqu’une partie informe le juge qu’elle estime ne pas être en mesure de donner suite à des mesures d’organisation de la procédure dès lors que certains des documents sollicités seraient confidentiels, celui-ci peut adopter une ordonnance enjoignant à cette partie de produire les documents en cause tout en prévoyant qu’ils ne seront pas communiqués à la partie adverse à ce stade (voir, en ce sens, arrêts du Tribunal du 8 juillet 2008, Franchet et Byk/Commission, T‑48/05, Rec. p. II‑1585, points 54 et 55, et du 18 mars 2009, Shanghai Excell M E Enterprise et Shanghai Adeptech Precision/Conseil, T‑299/05, non encore publié au Recueil, points 24 à 26).
It follows that, notwithstanding the differences between the Rules of Procedure of the General Court and those of the Civil Service Tribunal, the latter is none the less entitled to follow the same procedure as that followed by the General Court, namely, when a party informs the court that it is not able to comply with measures of organisation of procedure since some of the requested documents are confidential, that court can order that party to produce the requested documents, but provide that they will not be communicated to the other party at that stage (see, to that effect, Case T‑48/05 Franchet and Byk v Commission [2008] ECR II‑1585, paragraphs 54 and 55, and Case T‑299/05 Shanghai Excell M E Enterprise and Shanghai Adeptech Precision v Council [2009] ECR II‑0000, paragraphs 24 to 26).

Par ailleurs, le fait que la Commission, ainsi qu’elle l’a admis lors de l’audience devant le Tribunal en réponse à une question de celui-ci, n’ait jamais fait expressément référence, en première instance, à l’article 44, paragraphe 2, du règlement de procédure du Tribunal de la fonction publique est sans incidence, le Tribunal de la fonction publique étant tenu de choisir, de sa propre initiative, l’instrument procédural approprié pour compléter adéquatement l’instruction du dossier.
Furthermore, the fact that the Commission, as it accepted at the hearing before the Court in reply to a question from the bench, never referred expressly, at first instance, to Article 44(2) of the Rules of Procedure of the Civil Service Tribunal is of no consequence, since the Tribunal was required, of its own motion, to choose the appropriate procedural measure to complete the preliminary investigation of the case adequately.

La Commission précise que, quand bien même le règlement de procédure du Tribunal de la fonction publique, à la différence de celui du Tribunal, n’envisage pas la possibilité d’adopter une mesure d’instruction ordonnant aux parties au litige la production de documents, l’article 24 du statut de la Cour, applicable au Tribunal de la fonction publique, lui aurait permis d’adopter une telle ordonnance, cette disposition prévoyant, notamment, que le juge de l’Union peut demander aux parties de produire tous documents et de fournir toutes informations qu’il estime désirables.
The Commission states that although the Rules of Procedure of the Civil Service Tribunal, unlike those of the General Court, do not provide for the adoption of a measure of inquiry ordering the parties to the dispute to produce documents, Article 24 of the Statute of the Court of Justice, which is applicable to the Civil Service Tribunal, would have permitted the adoption of such a measure since that provision permits, inter alia, the Courts of the European Union to require the parties to produce all documents and to supply all information which they consider desirable.

Aucune dérogation ou exception à cette obligation n’étant prévue ni par le statut de la Cour de justice ni par le règlement de procédure du Tribunal de la fonction publique, la présentation d’une requête signée par le requérant lui‑même, même si celui‑ci est un avocat habilité à plaider devant une juridiction nationale, ne peut suffire aux fins de l’introduction d’un recours.
Since no derogation from or exception to that obligation is provided for by the Statute of the Court of Justice or the Rules of Procedure of the Civil Service Tribunal, the submission of an application signed by the applicant himself, even if he is a lawyer authorised to plead before a national court, cannot be sufficient for the purpose of bringing an action.
