Having regard to the Internal Agreement between the Representatives of the Governments of the Member States, meeting within the Council, on the financing of Community aid under the multiannual financial framework for the period 2008 to 2013 in accordance with the ACP-EC Partnership Agreement and on the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (3) (the ‘Internal Agreement’) setting up, amongst others, the 10th European Development Fund (10th EDF), and in particular Article 11(8) thereof,

1. se félicite de l'avis de la Cour des comptes qui indique que les comptes annuels des huitième, neuvième et dixième Fonds européens pour le développement pour l'exercice 2013 présentent fidèlement, dans tous leurs aspects significatifs, la situation financière des FED au 31 décembre 2013, et que le résultat de leurs opérations, leurs flux de trésorerie ainsi que la variation de l'actif net pour l'exercice clos à cette date est conforme au règlement financier des FED et aux normes comptables internationalement admises pour le secteur public;
1. Welcomes the Court of Auditors' opinion that the final annual accounts of the Eighth, Ninth and Tenth European Development Funds for the year 2013 present fairly, in all material respects, the financial position of the EDFs as of 31 December 2013, and that the results of their operations, their cash flows and the changes in net assets for the year-end, are in accordance with the provisions of the EDF financial regulation and with internationally accepted accounting standards for the public sector;

– vu le rapport annuel de la Commission du 14 avril 2014 sur la gestion financière des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2013,
– having regard to the Commission’s annual report of 14 April 2014 on the financial management of the eighth, ninth and tenth European Development Funds for the financial year 2013,

– vu le rapport annuel de la Commission du 27 avril 2011 sur la gestion financière des huitième, neuvième et dixième Fonds européens de développement pour l'exercice 2010,
– having regard to the Commission's annual report of 27 April 2011 on the financial management of the Eighth, Ninth and Tenth European Development Funds in 2010,

9. relève que, de l'avis de la Cour des comptes, le rapport de la Commission sur la gestion financière des huitième, neuvième et dixième FED en 2009 "présente une description précise de la réalisation des objectifs opérationnels de la Commission pour l'exercice donné (notamment concernant l'exécution financière et les activités de contrôle)", en dépit des effets négatifs de la crise économique qui a frappé un grand nombre de pays en développement;
9. Notes that, in the Court of Auditors' opinion, the Commission's report on the Financial Management of the 8th - 10th EDFs in 2009 "presents an accurate description of the achievement of the Commission’s operational objectives for the financial year (particularly concerning financial implementation and control activities)", despite the negative impact of the economic crisis which has hit a large number of developing countries;

11. se félicite de ce que, de l'avis de la Cour, le rapport de la Commission sur la gestion financière des septième, huitième, neuvième et dixième FED pour l'exercice 2008 présente "une description précise de la réalisation des objectifs opérationnels de la Commission pour l'exercice donné (...), de la situation financière et des événements qui ont eu une incidence notable sur les activités menées en 2008";
11. Notes with satisfaction that in the opinion of the Court of Auditors the Commission’s report on the financial management of the Seventh, Eighth, Ninth and Tenth EDFs for the financial year 2008 presents ‘an accurate description of the achievement of the Commission’s operational objectives for the financial year (.), the financial situation and the events that had a significant influence on the activities carried out in 2008’;

demande aux États membres de continuer à œuvrer en faveur d’une interdiction internationale des armes à dispersion, de développer les moyens de détecter et de détruire les munitions n’ayant pas explosé et de fournir une assistance financière et technique aux pays concernés, ainsi que de l’aboutissement des négociations en cours sur le renforcement de l’interdiction mondiale des mines terrestres, l’interdiction mondiale des armes contenant de l’uranium et un contrôle mondial des transferts d’armes conventionnelles; dans cette optique, juge embarrassant qu’en dépit du fait que le code de conduite de l’Union sur les exportations d’armes fêtera son dixième anniversaire en 2008, celui-ci n’est pas encore contraignant et les exportations incontrôlées d’armes par des États membres de l’Union semblent continuer sans beaucoup d’entraves, même à destination de gouvernements de pays où l’Union lance une opération de la PESD ou envisage de le faire; constate en outre l’existence d’un risque que des armes puissent, par le territoire de l’Union, être transférées vers des pays tiers via des États membres où le contrôle des exportations est moins strict et/ou, de façon irresponsable, il est fait un usage non rigoureux du certificat international d’importation; souligne dès lors qu’il est essentiel que tous les États membres appliquent les normes les plus rigoureuses en matière de contrôle des exportations d’armes, en sorte d’empêcher que des armes de l’Union n’alimentent des conflits;
Calls on the Member States to continue working towards the goal of an international ban on cluster munitions, to further develop ways to detect and destroy unexploded ordnance, to provide financial and technical assistance to the countries concerned and to continue to work towards the conclusion of the ongoing negotiations on strengthening the global ban on landmines, a global ban on uranium weapons and global control of conventional arms transfers; in this light, finds it embarrassing that, despite the fact that the EU Code of Conduct on Arms Exports will celebrate its tenth anniversary in 2008, it is not yet legally binding and uncontrolled arms exports from EU Member States seem to be continuing without much hindrance, even to governments in countries where the EU is launching or considering an ESDP operation; further notes the danger that weapons may be transferred through the EU via those Member States with less strict export controls to third countries and/or by an irresponsibly flexible use of the International Import Certificate; stresses, therefore, that it is important for all Member States to apply the highest standards in terms of arms export controls, so as to prevent EU weapons from fuelling conflicts;
