What emerges first and foremost from that report is that a rational investor, acting in accordance with the rules of a market economy, would not have made a similar, single capital injection of Pta 130 billion into Iberia for at least two reasons: first, in a comparable situation a rational investor would try to minimize his initial input and make further instalments as and when the objectives of the recovery plan were met; secondly, the operation is too much of a financial risk because of the uncertainties which still surround the future of the group, in particular in Latin America.

III. LA DECISION En définitive, la Commission considère que l'injection de 120 milliards de pesetas doit être considérée comme une aide d'Etat (au sens de l'Article 92 du traité) au regard du principe de l'investisseur avisé en économie de marché, car : - la situation financière d'Iberia dans le passé a été caractérisée par une faible rentabilité du capital investi, des dettes élevées et des cash-flow réduits. - une flotte vieillissante - une faible productivité.
III. THE DECISION The Commission considers that the capital injection of PTA 120 billion counts as a State aid within the meaning of Article 92 of the Treaty and when measured against the principle of an investor operating in normal market conditions, given - Iberia's record of low returns on capital, significant debts and cash flow problems, - the airline's ageing fleet, and - its low productivity.

However a higher capital injection could be considered to be feasible on commercial grounds; - to improve the financial structure and standing of the company, through reducing excessive gearing (the level of debt to equity) and thereby creating a solid basis for the attraction of private capital into the Iberia Group; - to reflect the strategic interest of TENEO in the Iberia Group and in particular to demonstrate the commitment of TENEO, alongside Iberia's other stakeholders (its managements, employees, commercial partners and lenders) to the fulfilment of its restructuring plan and its return to a financial viability and healthy growth.
