4. Nonobstant le paragraphe 1 du présent article, un État membre peut, pour satisfaire aux obligations énoncées audit paragraphe, faire masse des moyens financiers disponibles résultant des contributions obligatoires versées par les établissements de crédit au titre de systèmes existants de contributions obligatoires mis en place par un État membre sur son territoire pour couvrir les coûts liés au risque systémique, à la défaillance et à la résolution des établissements.
4. Notwithstanding paragraph 1 of this Article, a Member State may, for the purpose of fulfilling its obligations thereunder, raise the available financial means through the mandatory contributions paid by credit institutions to existing schemes of mandatory contributions established by a Member State in its territory for the purpose of covering the costs related to systemic risk, failure, and resolution of institutions.

2. Notwithstanding the Financial Regulation and the Implementing Rules, a certificate on the financial statements shall be compulsory only whenever the cumulative amount of interim payments and balance payments made to a participant is equal to EUR 375 000 or more for an indirect action.
