2. Interest and other gains attributable to support from the European Structural and Investment Funds paid to financial instruments shall be used for the same purposes, including the reimbursement of management costs incurred or payment of management fees of the financial instrument in accordance with Article 36(1)(d), and expenditure paid in line with Article 36(2), as the initial support from the European Structural and Investment Funds either within the same financial instrument, or following the winding up of the financial instrument, in other financial instruments or forms of support in accordance with the specific objectives set out under a priority, until the end of the eligibility period .

8. 8. An investment firm shall, when holding financial instruments belonging to clients, make adequate arrangements so as to safeguard clients' ownership rights, especially in the event of the investment firm's insolvency, and to prevent the use of a client's instruments on own account except with the client's express consent.

4. Nonobstant les dispositions des paragraphes 1 et 2, lorsque la superficie totale notifiée conformément à l'article 16, paragraphe 1, point a), est inférieure au nombre d'hectares indiqué dans la dotation de l'exercice financier en question accordée à l'État membre en vertu de l'article 14, paragraphe 1, du règlement (CE) n° 1493/1999, les dépenses déclarées au titre de l'exercice financier en question ne sont financées qu'à concurrence d'un montant égal au produit de la superficie totale notifiée par le montant de l'aide moyenne à l'hectare tel qu'il résulte du rapport entre le montant alloué à l'État membre en vertu de l'article 14, paragraphe 1, du règlement (CE) n° 1493/1999 et le nombre d'hectares prévus.
4. Notwithstanding paragraphs 1 and 2, where the total area notified in accordance with Article 16(1)(a) is less than the number of hectares indicated in the allocation for the financial year made to the Member State pursuant to Article 14(1) of Regulation (EC) No 1493/1999, then expenditure declared for the financial year in question shall be financed only up to a limit equal to the total area notified multiplied by the average amount of aid per hectare; this figure is calculated as a ratio between the amount allocated to the Member State pursuant to Article 14(1) of Regulation (EC) No 1493/1999 and the anticipated number of hectares.

3. Nonobstant les dispositions des paragraphes 1 et 2, lorsque la superficie totale notifiée conformément à l'article 16, paragraphe 1, point a), est inférieure au nombre d'hectares indiqué dans la dotation de l'exercice financier en question accordée à l'État membre en vertu de l'article 14, paragraphe 1, du règlement (CE) no 1493/1999, les dépenses déclarées au titre de l'exercice financier en question ne sont financées qu'à concurrence d'un montant calculé en réduisant la limite visée au paragraphe 1 proportionnellement à la différence constatée par rapport à la superficie totale notifiée.
3. Notwithstanding paragraphs 1 and 2, where the total area notified in accordance with point (1) of Article 16(1) is less than the number of hectares indicated in the allocation for the financial year made to the Member State pursuant to Article 14(1) of Regulation (EC) No 1493/1999, then expenditure declared for the financial year in question shall be financed only up to a limit which is calculated by reducing the limit referred to in paragraph 1 in proportion to the shortfall in the total area notified.
