However, the introduction of new, open-access international rail passenger services with intermediate stops should not be used to open up the market for domestic passenger services, but should merely focus on stops that are ancillary to the international service. The principal purpose of the new services should be to carry passengers travelling on an international journey.

Implementing acts related to the principal purpose of rail services, the assessment of impact of new international services on the economic equilibrium of public service contracts, the levies on railway undertakings providing passenger services, access to the services to be supplied in essential service facilities, the details on the procedure to be followed to obtain a licence, the modalities for the calculation of direct cost for the application of the charging for the cost of noise effects and for the application of the differentiation of the infrastructure charge to give incentives to equip trains with ETCS and the common principles and practices for the regulatory bodies decision-making should not be adopted by the Commission where the committee established pursuant to this Directive delivers no opinion on the draft implementing act presented by the Commission.

(6) Strengthening of the rights of international rail passengers should build on the existing system of international law on this subject contained in Appendix A – Uniform rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) to the Convention concerning International Carriage by Rail (COTIF) of 9 May 1980, as modified by the Protocol for the modification of the Convention concerning International Carriage by Rail of 3 June 1999 (1999 Protocol).

La présente directive porte sur l’ouverture du marché pour les services ferroviaires internationaux de transport de voyageurs à l’intérieur de la Communauté et ne devrait donc pas porter sur les services entre un État membre et un pays tiers.
The aim of this Directive is to address the opening of the market for international rail passenger services within the Community, and it should therefore not concern services between a Member State and a third country.

(12) Le renforcement des droits en matière d'indemnisation et d'assistance en cas de retard, de correspondance manquée ou d'annulation d'un service international devrait aboutir à un accroissement des incitations en faveur du marché des services ferroviaires internationaux de voyageurs, au bénéfice des voyageurs.
(12) Strengthened rights of compensation and assistance in the event of delay, missed connection or cancellation of an international service should lead to greater incentives for the international rail passenger market, to the benefit of passengers.

(10) L’instauration de limites de responsabilité en cas de perte des bagages ou de dommages à ces derniers ainsi qu’en cas de dommages résultant d’un retard, d’une correspondance manquée ou d’une annulation de voyage devrait aboutir à une plus grande clarté et créer des incitations en faveur du marché des services ferroviaires internationaux de voyageurs, au bénéfice des usagers.
(10) The introduction of liability limits for loss of, or damage to, luggage and for damage occasioned by delay, missed connection or cancellation of the journey should lead to greater clarity and should provide incentives for the international rail passenger market, to the benefit of the passengers.
