Parallèlement, le respect des spécifications d’interopérabilité en général et l’utilisation du système commun de signalisation ERTMS, en particulier, deviennent des conditions liées à l’obtention d’un financement communautaire : comme conséquence logique de l’ouverture du marché à la concurrence toutes les entreprises ferroviaires doivent pouvoir bénéficier des infrastructures ferroviaires financées avec des fonds européens et pas seulement celles disposant d’équipements spécifiques nationaux.
Compliance with the interoperability specifications in general and use of the common signalling system (ERTMS) in particular will also be essential in order to obtain Community funding. The logical consequence of opening up the market to competition is that all railway undertakings must be able to benefit from having railway infrastructure which has been financed from European spending and not only those which have specific national equipment.

(1) La directive 91/440/CEE du Conseil, du 29 juillet 1991, relative au développement de chemins de fer communautaires , dispose que les entreprises ferroviaires titulaires d'une licence se voient accorder, à titre transitoire, un droit d'accès au réseau transeuropéen de fret ferroviaire et, au plus tard à partir de 2008, à l'ensemble du réseau ferroviaire pour les services de fret internationaux.
(1) Council Directive 91/440/EEC of 29 July 1991 on the development of the Community's railways provides that licensed railway undertakings are granted access rights on the trans-European Rail Freight Network and at the latest from 2008 on the whole network for international rail freight services.

Le texte dispose également que la directive a pour objet d'établir les conditions qui doivent être satisfaites pour réaliser, sur le territoire communautaire, l'interopérabilité du système ferroviaire transeuropéen conventionnel, ce qui signifie qu'elle s'applique à l'intégralité du réseau ferroviaire de l'Union européenne.
An additional clause states that the Directive establishes the conditions to be met to achieve interoperability of the trans-European conventional rail system, thus applying the provisions of the Directive to the entire railway network in the European Union.

7. Sans préjudice des réglementations communautaire et nationale relatives à la politique de la concurrence et des institutions compétentes en la matière, l'organisme réglementaire créé conformément à l'article 30 de la directive 2001/14/CE, ou tout autre organisme disposant du même degré d'indépendance, contrôle la concurrence sur les marchés des services ferroviaires, y compris le marché du transport de fret ferroviaire.
7. Without prejudice to Community and national regulations concerning competition policy and the institutions with responsibility in that area, the regulatory body established pursuant to Article 30 of Directive 2000/14/EC, or any other body enjoying the same degree of independence shall monitor the competition in the rail services markets, including the rail freight transport market.
