A private prosecution has been brought against Mr Hans-Peter Martin in the Vienna Regional Criminal Court on 6 June 2007 by Merkur Treuhand Wirtschaftstreuhand- und Steuerberatungs Gesellschaft mit beschränkter Haftung for commercial defamation pursuant to Section 152 of the Austrian Criminal Code on the ground that, both on his website www.hpmartin.net and in APA-OTS press release OTS0189 5 11 0473 NEF0006 in connection with the accusations against him (by the EU anti-fraud authority OLAF) of improper use of the secretarial assistance allowance for staff, he had claimed that it had been established after a comprehensive, detailed investigation that he had in no way improperly used EU monies and that fault had been found only with a formal error on the part of his accounts manager at the time, Mr Christoph Matznetter, a tax adviser now State Secretary for Finance in the Austrian Government, who, according to Mr Martin, had incorrectly charged three staff computers and two telephone bills to the secretarial assistance allowance instead of to the office expenses allowance.

The private plaintiff states that a client of many years’ standing had already terminated its contract for that reason. Since, according to the plaintiff, Mr Martin is aware that, in reality, the plaintiff is not responsible for any errors in accounting for the secretarial assistance allowance, but, rather, that costs were charged as expressly instructed by Mr Martin himself, he has committed commercial defamation and should be punished accordingly.

[77] 7 Grounds for refusal: (a) where enforcement would run counter to the fundamental principles of the legal system of the requested State; (b) where the requested State considers the offence for which the sentence was passed to be of a political nature or a purely military one; (c) where the requested State considers that there are substantial grounds for believing that the sentence was brought about or aggravated by considerations of race, religion, nationality or political opinion; (d) where enforcement would be contrary to the international undertakings of the requested State; (e) where the act is already the subject of proceedings in the requested State or where the requested State decides to institute proceedings in respect of the act; (f) where the competent authorities in the requested State have decided not to take proceedings or to drop proceedings already begun, in respect of the same act; (g) where the act was committed outside the territory of the requesting State; (h) where the requested State is unable to enforce the sentence; (i) where the request is grounded on Article 5.e ("if it considers that it cannot itself enforce the sanction, even by having recourse to extradition, and that the other State can") and none of the other conditions mentioned in that article is fulfilled; (j) where the requested State considers that the requesting State is itself able to enforce the sentence; (k) where the age of the sentenced person at the time of the offence was such that he could not have been prosecuted in the requested State; (l) where under the law of the requested State the sentence imposed can no longer be enforced because of the lapse of time; (m) where and to the extent that the sentence imposes a disqualification.

Where despite the occurrence of any such event manufacture is continued because of a decision of the Company and subsequently, through either the continuation of that event or the occurrence of a further event, complete performance of the contractual obligations of the insured proves impossible or is judged inopportune by the Company, the manufacturing risk shall materialise on the date of suspension or completion of manufacture provided six months have elapsed since the occurrence of the event which was the initial cause, or since the initial decision of the Company, as referred to in the preceding paragraph.
