In addition to the amounts referred to in paragraph 4, the implementing act referred to in that paragraph shall also include the funds transferred to the EAFRD in application of Article 136a(1) of Regulation (EC) No 73/2009 and Article 7(2) of Regulation (EU) No [DP] and the funds transferred to the EAFRD in application of Articles 10b and 136 of Regulation (EC) No 73/2009 in respect of calendar year 2013".

(3) Where a ship referred to in subsection (2) is fitted only with water-tube boilers and the piping system referred to therein discharges steam, a foam extinguisher of at least 135 L capacity or an equivalent fire extinguisher set forth in Schedule IV shall be provided.

The Member State may maintain its national interim emergency measures until the implementing acts mentioned in this paragraph have been adopted.

3. The advisory procedure applies, as a general rule, for the adoption of implementing acts not falling within the ambit of paragraph 2, but it may also apply, in duly justified cases, for the adoption of the implementing acts referred to in that paragraph.
