IN-CONTEXT TRANSLATIONS

In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

Calls on the Member States, the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy, the European External Action Service (EEAS) and the Commission to set out clear benchmarks for the forthcoming elections in Cambodia, consistent with international law on freedom of expression, association and assembly, and to publicly communicate these benchmarks to the Cambodian authorities and the opposition; calls on the EEAS to make the amount of EU financial assistance dependent on improvements in the human rights situation in the country.

B. whereas restrictions on freedom of expression have serious consequences, should be very limited, and can only be justified subject to narrow and strict conditions provided by laws which themselves are considered legitimate under international law; whereas freedom of expression is a fundamental right and is closely linked to press and media freedom and pluralism; whereas states that have signed up to the International Covenant on Civil and Political Rights (ICCPR) and to the European Convention on Human Rights (ECHR) are obliged to ensure that independent, free and pluralistic press and media are guaranteed;

39. se félicite de l’adoption par le Conseil des droits de l’homme des Nations unies d’une résolution reconnaissant des droits relatifs à l’internet, notamment ceux concernant l’accès au réseau et la liberté d’expression; souligne notamment la demande d’œuvrer en faveur de «la promotion, la protection et la jouissance des droits de l’homme, y compris le droit à la liberté d’expression, sur l’internet et à travers d’autres technologies», précisant que ces droits doivent être respectés sans considération de frontières, ni de média; demande que l’Union et ses États membres transposent cette résolution en droit interne et assurent sa promotion au niveau international;
39. Welcomes the adoption by the UN Human Rights Council of a resolution recognising internet rights, particularly concerning access to the internet and freedom of expression; stresses in particular the appeal to strive for ‘the promotion, protection and enjoyment of human rights, including the right to freedom of expression, on the internet and in other technologies’, noting that these rights must be respected regardless of frontiers and through any media; calls on the EU and Member States to implement this resolution in domestic law and ensure its promotion at international level;

9. considère que les modifications de l'article 301 du code pénal, , adoptées par le parlement turc le 30 avril 2008, constituent, un premier pas dans la voie d'une réforme fondamentale de cet article ainsi que d'autres articles du code pénal, et attend de nouvelles initiatives à cet égard; souligne que des progrès doivent être réalisés quant à la liberté d'expression, tant sur le plan théorique que dans la pratique; déplore le fait que le nombre de personnes poursuivies sur la base de dispositions juridiques autorisant des restrictions arbitraires à l'expression d'opinions non violentes a encore augmenté en 2007 ; considère que l'abrogation de l'article 301 du code pénal et d'autres dispositions juridiques représentant une restriction injustifiable de la liberté d'expression garantie par le droit international serait la meilleure solution pour assurer que la Turquie garantisse pleinement la liberté d'expression et la liberté de la presse, conformément aux normes consacrées par la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales (CEDH);
9. Considers the changes to Article 301 of the Penal Code, adopted by the Turkish parliament on 30 April 2008, to be a first step towards a fundamental reform of that article as well as other articles of the Penal Code, and looks forward to further moves in this respect; stresses that progress has to be achieved regarding freedom of expression, both in theory and in practice; deplores the fact that the number of persons prosecuted under legal provisions allowing for arbitrary restrictions on the expression of non-violent opinion has further increased in 2007 ; is of the view that the repeal of Article 301 and other legal provisions representing an illegitimate restriction on freedom of expression as guaranteed by international law would be the best solution in order to ensure that Turkey fully guarantees freedom of expression and press freedom in line with the standards enshrined in the European Convention for the protection of Human Rights and Fundamental Freedoms (ECHR);

6. 6. All acts of the executive agency, and in particular all decisions adopted and contracts concluded by it, must provide explicitly that the Commission's internal auditor, OLAF and the Court of Auditors may conduct on-the-spot inspections of the documents of all contractors and sub-contractors which have received Community funds, including at the premises of the final beneficiaries.
