Lorsqu'un nouveau producteur-exportateur de la République populaire de Chine fournit à la Commission des éléments de preuve suffisants pour établir: a) qu'il n'a pas exporté vers l'Union le produit décrit au paragraphe 1 au cours de la période comprise entre le 1er juillet 2009 et le 30 juin 2010 (période d'enquête initiale), b) qu'il n'est lié à aucun exportateur ou producteur de la République populaire de Chine soumis aux mesures antidumping instituées par le présent règlement, c) qu'il a effectivement exporté vers l'Union le produit concerné ou qu'il s'est engagé d'une manière irrévocable par contrat à exporter une quantité importante vers l'Union après la fin de la période d'enquête initiale, la Commission peut modifier l'annexe I en ajoutant le nouveau producteur-exportateur aux sociétés ayant coopéré non retenues dans l'échantillon de l'enquête initiale et donc soumises au droit moyen pondéré n'excédant pas 56,9 %.
4. Where any new exporting producer in the People's Republic of China provides sufficient evidence to the Commission that: (a) it did not export to the Union the product described in paragraph 1 in the period between 1 July 2009 and 30 June 2010 (original investigation period), (b) it is not related to any exporter or producer in the People's Republic of China which is subject to the anti-dumping measures imposed by this Regulation, (c) it has actually exported to the Union the product concerned or it has entered into an irrevocable contractual obligation to export a significant quantity to the Union after the end of the original investigation period, the Commission may amend the Annex I by adding the new exporting producer to the cooperating companies not included in the sample of the original investigation and thus subject to the weighted average duty of not exceeding 56.9 %.

Afin de permettre à l’Union de réagir rapidement à des changements concernant l’évaluation du caractère sensible des exportations soumises à des autorisations générales d’exportation de l’Union, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne aux fins de la modification de l’annexe II du règlement (CE) no 428/2009 en ce qui concerne le retrait de destinations du champ d’application des autorisations générales d’exportation de l’Union.
In order to allow for a swift Union response to changing circumstances as regards the assessment of the sensitivity of exports under Union General Export Authorisations, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of amending Annex II to Regulation (EC) No 428/2009 as regards the removal of destinations from the scope of the Union General Export Authorisations.

In the light of the contents of recitals 6 to 16 and the reasoning in recitals 60 to 64 above, this claim cannot be accepted as the investigation confirmed that for these operators, in particular because they did not have any exports to the Union during the IP, it was not possible to trace their products when exported to the Union and they had generally no idea of the timing of the export and of the price paid or payable by Union importers, hence an export price and a dumping margin could not be reliably established for these producers.

More specifically, the producers in the US sample did not export the product concerned to the Union and the investigated traders/blenders sourced bioethanol from various producers, blended it and sold it in particular for export to the Union, hence, contrary to allegations made by the above parties, it was not possible to trace all purchases individually and compare the normal values with the relevant export prices and it is not possible to identify the producer at the moment of the export to the Union.
