IN-CONTEXT TRANSLATIONS

L'article 33, paragraphe 9, du règlement (CE) no 1254/1999 prévoit que le paiement des restitutions à l'exportation d'animaux vivants de l'espèce bovine est subordonné au respect de la législation communautaire concernant le bien-être des animaux et, notamment, de la directive 91/628/CEE du Conseil du 19 novembre 1991 relative à la protection des animaux en cours de transport , modifiée en dernier lieu par la directive 95/29/CE .
Article 33(9) of Regulation (EC) No 1254/1999 provides that the payment of the refund for exports of live bovine animals is subject to compliance with Community legislation concerning animal welfare and, in particular, Council Directive 91/628/EEC of 19 November 1991 on the protection of animals during transport , as last amended by Directive 95/29/EC .

Payment of export refunds for live bovine animals falling within CN code 0102 (hereinafter referred to as the animals), pursuant to Article 33(9), second subparagraph, of Regulation (EC) No 1254/1999, shall be subject to compliance, during the transport of the animals to the first place of unloading in the third country of final destination, with the provisions of Directive 91/628/EEC and of this Regulation.

L'expérience montre qu'il est nécessaire d'améliorer la mise en œuvre des exigences en matière de bien-être des animaux applicables à l'octroi des restitutions à l'exportation desdits animaux.
Experience has shown the need to improve the enforcement of animal welfare requirements for the granting of refunds for the export of those animals.

Animaux reproducteurs de race pure : dans les cas où le taux de restitution est plus élevé que celui applicable aux animaux destinés à l'abattage, il ne peut être versé de restitutions à l'exportation que pour les génisses et les vaches dont l'âge n'excède pas 30 mois, eu égard à la nécessité de prévenir toute utilisation abusive du régime de restitution (par exemple l'exportation d'animaux d'un âge plus élevé, dont la valeur reproductive est médiocre et qui sont plus que d'autres susceptibles d'être abattus peu de temps après l'exportation).
For pure-bred breeding animals: where the refund rate is higher than the one for animals for slaughter, payment of export refunds shall be limited to heifers and cows of no more than 30 months in order to prevent any abuse of the refund system. For example, where older animals are exported with reduced reproductive value and increased likelihood of slaughter soon after export.

Animaux destinés à l'abattage: seules seront éligibles les exportations d'animaux mâles vers des pays tiers qui importent traditionnellement de tels animaux en grand nombre pour des raisons culturelles ou religieuses (Égypte et Liban).
For animals for slaughter: only in the case of export of male animals to third countries traditionally importing substantial numbers of such animals for cultural and/or religious reasons (Egypt and Lebanon).

Exportation d'animaux vivants de l'UE vers les pays tiers: En ce qui concerne les exportations d'animaux, le règlement du Conseil 615/98/CE subordonne l'octroi de restitutions à l'exportation pour les bovins à la mise en œuvre conforme des dispositions de protection durant le transport (il n'existe aucune restitution pour les transports au sein de l'UE).
Export of live animals from the EU to third countries: In relation to exports of livestock, Council Regulation 615/98/EC makes the granting of an export refund for cattle conditional on the satisfactory implementation of protective provisions during transport (no such refunds exist for transportation inside the EU).

N.B. : 1. L'interdiction d'exportation de certains animaux vivants et produits à base de viande présentant un danger de transmission de la fièvre aphteuse sera levée ce jour, le 30 avril à 16 heures, pour les pays suivants : Hongrie, Estonie, Slovénie, Bulgarie, Roumanie, les répoubliques tchèque et slovaque et la Pologne (pour les produits animaux seulement, étant donné qu'ils ne sont pas préparés à appliquer aux exportations d'animaux vivants la condition d'isolement de 15 jours). 2. Les exigences fixées par la CE concernent essentiellement la certification, sans possibilité de fraude, du statut des animaux et de produits à base de viande indemnes de maladie, la notification préalable aux postes douaniers d'exportation de ces produits vers la Commuanuté, le testage des animaux au regard de la fièvre aphteuse et un isolement des animaux pendant 15 jours.
Note: (1) The ban on exports for certain livestock and meat products which present a danger of transmitting foot and mouth disease will be lifted as of 16.00 h today (April 30) for: Hungary, Estonia, Slovenia, Bulgaria, Roumania, the Czech and Slovak Republics and Poland (for animal products only, as they are not prepared to apply the 15 day quarantine requirement for live animal exports) (2) The requirements laid down by the EC essentially amount to fraud proof certification of the disease free status of animals and meat products, pre-notification to the customs posts of exports of these products to the Community, testing of animals for foot and mouth and a 15 day quarantine for animals (3) It should be noted that these import requirements are provisional and will be subject to a continual review.
