IN-CONTEXT TRANSLATIONS

Conformément à l’article 3 du règlement (CE) n° 1831/94[5] concernant les irrégularités et le recouvrement des sommes indûment versées ainsi que l’organisation d’un système d’information dans ce domaine, huit États membres bénéficiaires ont signalé 228 cas d’irrégularités impliquant des contributions communautaires pour un montant de 186 604 797 euros.

Primarily, annul Article 1 of the contested decision and the annex thereto, in so far as that provision and annex relate to interest, in the amount of EUR 4 703 231,78, which, it is alleged, the Netherlands wrongly failed to calculate in respect of a number of claims relating to the late payment of additional levies and unlawfully granted export refunds;

9. se félicite du fait que le montant estimé des irrégularités soit inférieur de 34 % par rapport à 2007; insiste sur le fait que le nombre relativement bas d'irrégularités semble essentiellement dû au seuil plus élevé prévu pour la notification des cas (10 000 euros), seuil introduit par le règlement (CE) n° 1848/2006 de la Commission du 14 décembre 2006 concernant les irrégularités et la récupération des sommes indûment versées dans le cadre du financement de la politique agricole commune, ainsi que l'organisation d'un système d'information dans ce domaine ;

Welcomes the fact that the estimated amount affected by irregularities was 34% lower than in 2007; stresses that the relatively small number of irregularities would appear to stem mainly from the higher threshold for compulsory notification (EUR 10 000) introduced under Commission Regulation (EC) No 1848/2006 of 14 December 2006 concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the common agricultural policy and the organisation of an information system in this field ;

The Secretary-General stated that under Articles 16(2) and 27(3) of the Rules Governing the Payment of Expenses and Allowances he was required to give instructions for the recovery of the sum of EUR 118 360.18 that had been improperly paid or, if necessary, to propose that the Bureau temporarily suspend the payment of some of the applicant’s allowances, in accordance with Article 27(4) of the said Rules.

103 S’agissant, enfin, de la branche du présent moyen concernant la violation de l’article 27, paragraphe 3, de la réglementation FID, selon laquelle le secrétaire général avait, sans avoir consulté les questeurs au préalable, acquis la certitude, dès sa décision du 26 février 2003, que la somme de 176 516 euros avait été indûment versée (voir point 70 ci-dessus), celle-ci doit être rejetée comme irrecevable en vertu de l’article 44, paragraphe 1, sous c), et de l’article 48, paragraphe 2, premier alinéa, du règlement de procédure du Tribunal.
103. Lastly, the part of the present plea concerning the breach of Article 27(3) of the Rules Governing the Payment of Expenses and Allowances – according to which the Secretary-General was satisfied, without having previously consulted the Quaestors, as from the date of his decision of 26 February 2003 that the sum of EUR 176 516 had been improperly paid (see paragraph 70 above) – must be dismissed as inadmissible under Article 44(1)(c) and the first subparagraph of Article 48(2) of the Rules of Procedure of the Court of First Instance.

70 S’agissant de la violation de l’article 27, paragraphe 3, de la réglementation FID, le requérant considère que, contrairement à ce qu’impose cette disposition, le secrétaire général avait, sans avoir consulté les questeurs au préalable, acquis la certitude, dès sa décision du 26 février 2003 (voir point 41 ci-dessus), que la somme de 176 516 euros avait été indûment versée.
70. With regard to the breach of Article 27(3) of the Rules Governing the Payment of Expenses and Allowances, the applicant considers that, contrary to the requirements of that provision, the Secretary-General was satisfied, without having previously consulted the Quaestors, as from the date of his decision of 26 February 2003 (see paragraph 41 above) that the sum of EUR 176 516 had been improperly paid.

Pour compenser les sommes indûment versées (29000 euro), l'INPS a complètement cessé de payer la pension.
In order to offset the sums overpaid (EUR 29 000), the INPS ceased all pension payments.
