TRADUCTIONS EN CONTEXTE

Lors d’une réunion plénière ayant eu lieu au Département d’État, l’Union européenne et les États-Unis ont convenu de prendre plusieurs mesures visant à coordonner les positions européennes et américaines sur les systèmes tiers et à lancer d’autres groupes de travail.
A plenary meeting was hosted by the Department of State, which agreed to take on several actions aimed at coordinating EU and US positions towards third systems and initiating further working groups.

Cette décision faite suite à l’annonce, effectuée le 10 février 2016 par Jonathan Hill, commissaire européen pour la stabilité financière, les services financiers et l’union des marchés des capitaux, et Timothy Massad, président de la CFTC, de l’adoption d’une approche commune pour les contreparties centrales européennes et américaines.
This follows the announcement of 10 February 2016 by Commissioner Hill and CFTC Chairman Timothy Massad on a common approach for transatlantic CCPs.

Notes that different regulatory approaches in the European Union and the US are costly for industries on both sides of the Atlantic; believes that there are significant efficiency gains to be tapped by aligning these approaches while still allowing authorities in the European Union and in the Unites States to maintain and achieve high quality standards and safety for their citizens;

v. se souvenir que la reconnaissance de l'équivalence du plus grand nombre de réglementations possible concernant la sécurité des véhicules serait l'une des réussites les plus importantes de l'accord et que cela implique de vérifier que les réglementations européenne et américaine assurent des niveaux semblables de protection, sans affaiblir le niveau de protection dans l'Union; souligner qu'il s'agit d'une étape essentielle sur la voie d'une convergence réglementaire complète dans ce secteur; constater néanmoins qu'il subsiste, en particulier dans le domaine de la sécurité automobile, de nombreuses différences entre produits américains et européens et préconiser le renforcement de la coopération entre l'Union européenne et les États-Unis dans le cadre de la commission économique des Nations unies pour l'Europe (CEE – ONU), notamment en ce qui concerne les nouvelles technologies ainsi que dans d'autres instances internationales de normalisation;
v. to remember that the recognition of equivalence of the greatest possible number of vehicle safety regulations would be one of the most important achievements of the Agreement and that this will require verifying that the EU and US regulations provide for a similar level of protection without lowering the level of protection in the EU; to stress that this must be a step towards full regulatory convergence in the sector; to point out that, nonetheless, especially in the area of automotive safety, there are many differences between US and EU products, and to urge the strengthening of EU-US cooperation in the framework of the United Nations Economic Commission for Europe (UNECE), especially regarding new technologies, as well as in other international standard-setting fora;

iv) en ce qui concerne le chapitre relatif à la coopération horizontale en matière de réglementation, favoriser la coopération bilatérale en matière réglementaire afin d'éviter les divergences superflues, notamment pour ce qui touche aux nouvelles technologies et aux nouveaux services, au profit de la compétitivité européenne et américaine et du choix des consommateurs; atteindre cet objectif grâce à un renforcement de l'échange d'informations et favoriser l'adoption et la mise en œuvre des instruments internationaux, dans le respect du principe de subsidiarité, sur la base des précédents concluants que constituent notamment les normes ISO ou les réalisations effectuées dans le cadre du Forum mondial de l'harmonisation des règlements concernant les véhicules (WP.29) de la Commission économique pour l'Europe des Nations unies (CEE-ONU); ne pas perdre de vue que la reconnaissance de l'équivalence du plus grand nombre possible de dispositions réglementaires concernant la sécurité des véhicules selon un niveau équivalent de protection vérifié serait l'une des réussites les plus importantes de l'accord; veiller à ce que l'évaluation d'impact réalisée préalablement à chaque acte réglementaire doive mesurer non seulement les incidences de celui-ci sur les échanges et les investissements, mais aussi ses répercussions sur les consommateurs et sur l'environnement; promouvoir la compatibilité réglementaire, sans mettre en péril les objectifs réglementaires et stratégiques légitimes ni porter atteinte aux compétences des législateurs européens et américains;
(iv) with regard to the horizontal regulatory cooperation chapter, to foster bilateral regulatory cooperation in order to avoid unnecessary divergence, particularly as regards new technologies and services, for the benefit of European and US competitiveness and consumer choice; to achieve this through enhanced information exchange and to improve the adoption and implementation of international instruments, whilst respecting the subsidiarity principle, on the basis of successful precedents such as ISO standards or under the United Nations Economic Commission for Europe's (UNECE) World Forum for Harmonisation of Vehicle Regulations (WP.29); to remember that the recognition of equivalence of the greatest possible number of vehicle safety regulations based on a verified equivalent level of protection would be one of the most important achievements of the agreement; to ensure that the prior impact assessment for each regulatory act should measure its impact on consumers and the environment next to its impact on trade and investment; to promote regulatory compatibility without compromising the legitimate regulatory and policy objectives and the competences of the EU and US legislators;

Ces démarches avaient pour objectif central de faire accepter l'équivalence entre les approches réglementaires européenne et américaine en matière de protection des investisseurs et des autres parties intéressées.
The key objective of these discussions has been to achieve recognition that EU regulatory approaches to the protection of investors and other stakeholders are equivalent to US rules.

Notes also that Europe has a duty to take into account the recent energetic corrective action undertaken in the United States in the wake of the Enron and WorldCom scandals by strengthening its financial regulatory and supervisory architecture, but also calls on EU institutions to ensure that their response to the Enron/WorldCom scandals is measured, proportionate and risk-based and targets the actual problems/risks; supports the swift reaction of American regulators but would have preferred mutual consultation rounds between European and American authorities at decision-making level before enacting such new laws; calls for a deepening of the dialogue;

La nécessité de partager les formidables coûts de développement des nouveaux systèmes et de se familiariser avec certaines technologies essentielles a poussé certaines entreprises européennes et américaines à former des partenariats, comme pour le chasseur d'attaque multirôles (Joint Strike Fighter) développé par Lockheed Martin et désormais rebaptisé F-35, le plus important programme dans l'histoire de l'armement, d'un montant de 200 milliards de dollars sur les 30 prochaines années.
The need to share the huge development costs of new systems, and to gain insight into essential technologies, has driven European and American firms into partnerships, such as the Lockheed Martin-led Joint Strike Fighter, now renamed F-35: the biggest defence programme in history, worth $200bn over the next 30 years.
