1. estime qu’il existe une incertitude juridique quant à savoir si le projet d’accord est compatible avec les dispositions des traités (article 16 du traité sur le fonctionnement de l'Union européenne) et la charte des droits fondamentaux de l’Union européenne (articles 7 et 8 et article 52, paragraphe 1) en ce qui concerne le droit des personnes physiques à la protection des données à caractère personnel; s'interroge, en outre, sur le choix de la base juridique, à savoir l'article 82, paragraphe 1, point d), et l'article 87, paragraphe 2, point a), du traité sur le fonctionnement de l'Union européenne(coopération policière et judiciaire), et non l'article 16 du traité sur le fonctionnement de l'Union européenne(protection des données);

Takes the view that there is legal uncertainty as to whether the draft agreement is compatible with the provisions of the Treaties (Article 16 TFEU) and the Charter of Fundamental Rights of the European Union (Articles 7, 8 and 52(1)) as regards the right of individuals to protection of personal data; questions, further, the choice of legal basis, i.e. Articles 82(1)(d) and 87(2)(a) TFEU (police and judicial cooperation) rather than Article 16 TFEU (data protection);

The internal-market dossiers to which the Belgian Presidency should give priority are as follows: Internal Market Council - functioning of the internal market: strategic programme/trans-European networks (see paragraph 4), - Community trade mark, - European company, - data protection: the Belgian Presidency accepted at the Internal Market Council meeting on 27 September that a report be presented on the progress of this dossier but, in agreement with the Commission departments, this report was removed from the agenda of 11 November with the intention that it be discussed by the Council on 16 December.
