Notes that this new legal entity under Article 187 TFEU will follow the model financial regulation for PPP bodies referred to in Article 209 of the Financial Regulation, charged with indirect management and it would take over all rights and obligations of the current Artemis and ENIAC Joint Undertakings; expects that complete and appropriate financial assessments of rights and obligations of each entity will be executed by the Court of Auditors; recalls, in this context, the joint statement by the European Parliament, the Council and the Commission on the separate discharge for Joint Undertakings under Article 209 of the Financial Regulation;

15. se déclare surpris par le fait que les dispositions de la convention de subvention n'accordent pas à la Cour des comptes le droit de contrôler les contributions en nature des sociétés membres de l'EFPIA, bien qu'elles figurent dans les états financiers de l'entreprise commune et soient estimées à 1 000 000 000 EUR sur la durée de vie de l'entreprise commune; observe que les contributions en nature sont contrôlées par l'entreprise commune conformément à l'article 12, paragraphes 4 et 5, du règlement (CE) n° 73/2008 et que l'entreprise commune a demandé l'avis de la Commission sur les droits de la Cour des comptes à contrôler les contributions en nature des sociétés membres de l'EFPIA;
15. Is surprised to learn that the provisions of the grant agreement do not recognise the right of the Court of Auditors to audit the in-kind contributions of EFPIA companies although they are recorded in the financial statements of the Joint Undertaking and are estimated at EUR 1 000 million over the lifetime of the Joint Undertaking; notes that in-kind contributions are audited by the Joint Undertaking in line with Article 12(4) and (5) of Regulation (EC) No 73/2008 and that the advice of the Commission was sought by the Joint Undertaking on the rights of the Court of Auditors to audit in-kind contributions of EFPIA companies;

11. rappelle que l'entreprise commune a été créée en décembre 2007 et qu'elle est devenue autonome en novembre 2009; fait part de son inquiétude au vu du fait que la méthodologie employée pour évaluer les contributions en nature, qui doit être définie dans les règles et procédures internes de l'entreprise commune, conformément à sa réglementation financière, a été approuvée par le comité directeur le 11 novembre 2011; souligne que les membres de la Fédération européenne des associations et industries pharmaceutiques (EFPIA) de l'entreprise commune n'ont par conséquent pas été en mesure de transmettre le rapport sur les coûts supportés pendant la première période de référence comme le prévoient les dispositions des conventions de subvention;
11. Recalls that the Joint Undertaking was set up in December 2007 and started to work autonomously in November 2009; expresses concern that the methodology for evaluating contributions in-kind to be defined in the Joint Undertaking's internal rules and procedures in compliance with its Financial Rules has been approved by the Governing Board on 11 November 2011; emphasises the fact that the European Federation of Pharmaceutical Industries and Associations (EFPIA) members of the Joint Undertaking were, therefore, unable to report on the costs incurred during the first reporting period as established in the grant agreements;

15. se déclare surpris par le fait que les dispositions de la convention de subvention n'accordent pas à la Cour des comptes le droit de contrôler les contributions en nature des sociétés membres de l'EFPIA, bien qu'elles figurent dans les états financiers de l'entreprise commune et soient estimées à 1 000 000 000 EUR sur la durée de vie de l'initiative en matière de médicaments innovants; observe que la contribution en nature est contrôlée par l'entreprise commune conformément à l'article 12, paragraphes 4 et 5 du règlement (CE) n° 73/2008 du Conseil et que l'entreprise commune demande l'avis de la Commission sur les droits de la Cour des comptes à contrôler les contributions en nature des sociétés membres de l'EFPIA;

Tout membre de l’entreprise commune peut proposer au directeur exécutif de détacher des membres de son personnel auprès de l’entreprise commune, conformément aux conditions prévues par l’accord correspondant visé à l’article 1er, paragraphe 3, des présents statuts.
Any member of the Joint Undertaking may propose to the Executive Director the secondment of members of its staff to the Joint Undertaking in accordance with conditions provided for in the relevant agreement referred to in Article 1(3) of these Statutes.
