(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte)1 . Ces principes comprennent notamment les éléments suivants: les entreprises ferroviaires doivent être gérées selon les principes applicables aux sociétés commerciales, les entités responsables de la répartition des capacités et de la tarification de l’infrastructure ferroviaire doivent être séparées des entités qui exploitent les services ferroviaires, il doit y avoir une séparation comptable, toute entreprise ferroviaire disposant d’une licence conforme aux critères UE devrait pouvoir accéder à l’infrastructure ferroviaire dans des conditions équitables et non discriminatoires, et les gestionnaires de l’infrastructure peuvent bénéficier d’un financement public.
(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast)3a , certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.

(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte). L’exercice de fonctions considérées comme essentielles (la délivrance aux entreprises ferroviaires de licences leur donnant accès au réseau ferroviaire, l’allocation des sillons et la détermination de la redevance à la charge des entreprises de transport pour l’utilisation du réseau) ne peut plus être assuré par les entreprises ferroviaires historiques, mais doit être confié à des gestionnaires indépendants.
The exercise of functions regarded as essential (the granting of licences to railway undertakings giving them access to the rail network, the allocation of train paths and the determination of the charges to be paid by transport undertakings for use of the network) may no longer be performed by the Member States’ railway undertakings that have traditionally done so but must be entrusted to independent managers.

Si le marché du transport ferroviaire de voyageurs doit devenir plus ouvert, il faut améliorer les conditions d'honorabilité en ce qui concerne le respect des conditions de travail que l'entreprise ferroviaire doit remplir pour obtenir une licence afin d'éviter un abaissement des conditions de travail en raison d'une plus grande concurrence.
If the rail passenger market is to become more open it is necessary to enhance the requirements of good repute as regards the respect of working conditions that a railway undertaking needs to be fulfil to obtain a licence in order to avoid a lowering of labour conditions due to more competition.

Those functions include, inter alia, issuing the railway companies with licences giving them access to the railway network, allocating the infrastructure capacities and determining the charge which is to be paid by the transport undertakings for use of the network.

Where an operator of service facilities belongs to a body or firm that holds a dominant position in one or more railway service markets for which the facility is used, the operator must be independent from that body to a certain extent in order to guarantee non-discriminatory access by railway undertakings to service facilities and the services supplied in these facilities.

(3) La directive 95/18/CE du Conseil du 19 juin 1995 concernant les licences des entreprises ferroviaires prévoit que toute entreprise ferroviaire doit disposer d'une licence et qu'une licence attribuée dans un État membre est valable sur tout le territoire de la Communauté.
(3) Council Directive 95/18/EC of 19 June 1995 on the licensing of railway undertakings provides that all railway undertakings must hold a licence and that a licence issued in a Member State shall be valid throughout the Community.
