The book value referred to in point (a) of paragraph 2, or the amount corresponding to the proportion of the associated undertaking's capital and reserves referred to in point (b) of paragraph 2, shall be increased or reduced by the amount of any variation which has taken place during the financial year in the proportion of the associated undertaking's capital and reserves represented by that participating interest; it shall be reduced by the amount of the dividends relating to that participating interest.

The undertakings covered by the Directive must fall within one of the following three categories: 1) main contractor or sub-contractors which, in the course of carrying out a contract for services, post a worker to carry out temporary work in the territory of a Member State on behalf of and under the direction of that undertaking (the "Rush Portuguesa" case); 2) temporary employment businesses which place a worker with a user undertaking operating in a Member State to carry out temporary work in as far as there is an employment relationship between the temporary employment business and the worker (the "Seco" case); 3) undertakings which place a worker with one of their establishments or with another undertaking, whether an associated undertaking or not, established in another Member State to carry out temporary work (intra-firm or intra-group mobility).
