As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis which fall within the area referred to in Article 1, point G of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/261/EC of 28 February 2008 on the signature, on behalf of the European Community, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (7).

M. Vic Toews: Pour revenir à certaines décisions qui ont été mentionnées, dans l'affaire M. c. H., la Cour suprême a clairement déclaré que la définition du mariage n'était pas touchée par ses commentaires au sujet des autres relations, qu'il s'agisse de relations de fait, entre personnes de sexe opposé ou de même sexe, ce qui est très semblable à la décision majoritaire du juge La Forest dans l'arrêt Egan, dans laquelle il a déclaré que la distinction entre le mariage et toutes les autres relations, y compris celles qui existent entre les couples de même sexe, était justifiée.
Mr. Vic Toews: Just dealing with some of the cases that were brought up, in the M. v. H. case, the Supreme Court clearly said the definition of marriage was not affected by its comments in respect of other relationships, whether it's common-law, opposite-sex, or indeed same-sex very similar to Justice La Forest's majority decision in Egan, where he said the distinction between marriage and all other relationships, including same-sex couples, was justified.
