Afin de déterminer si un cas de figure entre dans le champ d’application de la Charte, tel qu'il est défini à l’article 51, la Cour vérifie, en particulier, si la législation nationale concernée vise à transposer une disposition du droit de l'Union, la nature de cette législation, si elle ne poursuit pas des objectifs autres que ceux couverts par le droit de l'Union et s'il existe des règles du droit de l'Union spécifiques en la matière ou susceptibles de l'affecter[3].
To determine whether a situation falls within the scope of the Charter, as defined in its Article 51, the Court examines, in particular, whether the relevant national legislation is intended to implement a provision of EU law, the nature of the legislation, whether it pursues objectives other than those covered by EU law, and also whether there are specific rules of EU law on the matter or which may affect it[3].
