IN-CONTEXT TRANSLATIONS

1. The provisions of the Brussels I Regulation, which is annexed to this Agreement and forms part thereof, together with its implementing measures adopted pursuant to Article 74(2) of the Regulation and, in respect of implementing measures adopted after the entry into force of this Agreement, implemented by Denmark as referred to in Article 4 of this Agreement, and the measures adopted pursuant to Article 74(1) of the Regulation, shall under international law apply to the relations between the Community and Denmark.

Regrets that despite provisions in Directive 2006/114/EC to combat misleading practices in business-to-business advertising, some of these practices, notably ‘directory scams’, still persist; notes the Commission’s intention to propose shortly amendments to Directive 2006/114/EC focusing on business-to-business relations, in order to combat these practices more effectively; suggests that the Commission could, in this context, consider the merits of a targeted black list of commercial practices that are to be considered unfair in all circumstances in the field of business-to-business relations for Directive 2006/114/EC, similar to that which already exists for Directive 2005/29/EC; does not, however, consider it appropriate for the moment to extend the scope of Directive 2005/29/EC on business-to-consumer relations to include business-to-business unfair commercial practices;

As regards Switzerland, this Framework Decision constitutes a development of provisions of the Schengen acquis within the meaning of the Agreement signed between the European Union, the European Community and the Swiss Confederation concerning the association of the Swiss Confederation with the implementation, application and development of the Schengen acquis, which fall within the area referred to in Article 1(H) of Decision 1999/437/EC read in conjunction with Article 4(1) of Decision 2004/860/EC on the signing on behalf of the European Community and on the provisional application of certain provisions of that Agreement, and with Article 4(1) of Decision 2004/849/EC on the signing on behalf of the European Union, and on the provisional application of certain provisions of that Agreement,

Nonobstant les dispositions du paragraphe 1, les dispositions du présent accord priment les dispositions de tout accord bilatéral de coopération et d’assistance administrative mutuelle en matière douanière qui a été ou pourrait être conclu entre un État membre individuel et la République populaire de Chine, au cas où celles-ci seraient incompatibles avec celles du présent accord.
2. Notwithstanding the provisions of paragraph 1, the provisions of this Agreement shall take precedence over the provisions of any bilateral agreement on customs cooperation and mutual administrative assistance which has been or may be concluded between individual Member States and the People's Republic of China, insofar as the provisions of the latter are incompatible with those of this Agreement.

2. Nonobstant les dispositions du paragraphe 1, les dispositions du présent accord l'emportent sur les dispositions de tout accord bilatéral sur la coopération et l'assistance administrative mutuelle en matière douanière qui a été ou pourrait être conclu entre un État membre individuel et l'Inde, au cas où ces dernières seraient incompatibles avec celles du présent accord.
2. Notwithstanding the provisions of paragraph 1, the provisions of this Agreement shall take precedence over the provisions of any bilateral agreement on customs cooperation and mutual administrative assistance which has been or may be concluded between individual Member States and India, insofar as the provisions of the latter are incompatible with those of this Agreement.

(a) all the provisions of the Schengen acquis referred to in Annexes A, B, C and D to Council Decision 1999/436/EC of 20 May 1999 determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the Schengen acquis(2), and any act adopted by the Council establishing an instrument which has entered into force and constitutes a further development of one or more of these provisions, shall apply to Denmark, Finland and Sweden, in their relations between each other and with Belgium, Germany, Greece, Spain, France, Italy, Luxembourg, Netherlands, Austria and Portugal.
