Le règlement (UE) no 269/2014 du Conseil donne effet à certaines mesures prévues par la décision 2014/145/PESC et prévoit le gel des fonds et des ressources économiques des personnes physiques responsables d'actions ou de politiques compromettant ou menaçant l'intégrité territoriale, la souveraineté et l'indépendance de l'Ukraine, ou la stabilité ou la sécurité de l'Ukraine, qui soutiennent activement ou mènent de telles actions ou politiques ou qui font obstruction à l'action des organisations internationales en Ukraine, ainsi que des personnes physiques ou morales, entités ou organismes qui leur sont associés, des personnes morales, entités ou organismes qui soutiennent matériellement ou financièrement des actions qui compromettent ou menacent l'intégrité territoriale, la souveraineté et l'indépendance de l'Ukraine, des personnes morales, entités ou organismes en Crimée ou à Sébastopol dont la propriété a été transférée en violation du droit ukrainien, ou des personnes morales, entités ou organismes qui ont bénéficié d'un tel transfert; ou à des personnes physiques ou morales, des entités ou des organismes qui apportent un soutien matériel ou financier actif aux décideurs russes responsables de l'annexation de la Crimée ou de la déstabilisation de l'est de l'Ukraine, ou qui tirent avantage de ces décideurs.
Council Regulation (EU) No 269/2014 gives effect to certain measures provided for in Decision 2014/145/CFSP and provides for the freezing of funds and economic resources of natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine, or stability or security in Ukraine or which obstruct the work of international organisations in Ukraine, and natural or legal persons, entities or bodies associated with them; legal persons, entities or bodies supporting, materially or financially, actions which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine; legal persons, entities or bodies in Crimea or Sevastopol whose ownership has been transferred contrary to Ukrainian law, or legal persons, entities or bodies which have benefitted from such a transfer; or natural or legal persons, entities or bodies actively supporting, materially or financially, or benefitting from, Russian decision-makers responsible for the annexation of Crimea or the destabilisation of Eastern Ukraine.

In conclusion, the Court’s answer is that the prohibition on indirectly making available an economic resource, within the meaning of the regulation, encompasses acts relating to the supply and installation in Iran of a sintering furnace in working condition but not yet ready to use for the benefit of a third party which, acting on behalf, under the control or on the instructions of a person, an entity or a body listed in the annexes to that regulation, intends to use that furnace to manufacture, for the benefit of such a person, entity or body, goods capable of contributing to nuclear proliferation in that State.

The Irish Governement's commitments in the present case mainly relate to the following points : - the cost reduction will be carried out as envisaged in the plan; - the Irish Governement will periodically report to the Commission on the financial and economic development of Aer Lingus and the development of the programme; - Aer Lingus will not expand its operating fleet; - the Irish Government will not grant any further aid to Aer Lingus; - if created before the end of the restructuring period Aer Lingus Express will operate within Aer Lingus's operating fleet; - the European operations, the Transatlantic operations, and if and when created Aer Lingus Express will become and operate as separate legal entities with separate accounts; - Aer Lingus will not increase for the duration of the programme seats offered for sale to the public on scheduled flights on the Ireland/UK market, as well as on Dublin-London (Heathrow) route beyond well specified ceilings based on the traffic level achieved in the twelve months before notification; - Aer Lingus will use the money for restructuring purposes only and will not acquire shareholdings in any Community carrier.
