TRADUCTIONS EN CONTEXTE

Les modalités de traduction des brevets européens auquel est conféré un effet unitaire dans les États membres participants (ci-après dénommés «brevets européens à effet unitaire») devraient faire l'objet d'un règlement distinct, conformément à l'article 118, second alinéa, du traité sur le fonctionnement de l'Union européenne (TFUE).
Translation arrangements for European patents benefiting from unitary effect in the participating Member States (hereinafter ‘European patent with unitary effect’) should be established by means of a separate Regulation, in accordance with the second paragraph of Article 118 of the Treaty on the Functioning of the European Union (TFEU).

(3) Les modalités de traduction des brevets européens ayant un effet unitaire sur le territoire des États membres participants (ci-après «brevets européens à effet unitaire») devraient faire l’objet d’un règlement distinct, conformément à l’article 118, second alinéa, du traité sur le fonctionnement de l’Union européenne (ci-après, le «TFEU»).
(3) Translation arrangements for European patents with unitary effect in the territories of the participating Member States (hereinafter "European patent with unitary effect") should be established by a separate Regulation in accordance with Article 118(2) of the Treaty on the Functioning of the European Union (hereinafter "TFEU").

(4) Conformément à la décision 2011/167 du Conseil autorisant une coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, les modalités de traduction des brevets européens à effet unitaire devraient être simples, présenter un bon rapport coût-efficacité et correspondre à celles prévues dans la proposition de règlement du Conseil sur les dispositions relatives à la traduction pour le brevet de l’Union européenne[28], présentée par la Commission le 30 juin 2010, et aux éléments de compromis proposés par la présidence en novembre 2010 et largement soutenus par le Conseil[29].
(4) In accordance with Council Decision 2011/167/EU authorising enhanced cooperation in the area of the creation of unitary patent protection, the translation arrangements for European patents with unitary effect should be simple and cost-effective and correspond to those provided for in the proposal for a Council Regulation on the translation arrangements for the European Union patent[28], presented by the Commission on 30 June 2010, combined with the elements of compromise proposed by the Presidency in November 2010 that had wide support in the Council[29].

(6) L'Office européen des brevets étant responsable de la délivrance des brevets européens, les modalités de traduction du brevet européen à effet unitaire devraient se fonder sur la procédure en vigueur à l’Office.
(6) Since the European Patent Office is responsible for the grant of European patents, the translation arrangements for the European patent with unitary effect should be built on the current procedure in the European Patent Office.

L'OEB étant responsable de la délivrance des brevets européens, les modalités de traduction du brevet européen à effet unitaire devraient se fonder sur la procédure en vigueur à l'OEB.
Since the EPO is responsible for the grant of European patents, the translation arrangements for the European patent with unitary effect should be built on the current procedure in the EPO.

(10) Les droits conférés par le brevet européen à effet unitaire devraient permettre au titulaire du brevet d'éviter qu'un tiers n'exploite directement ou indirectement, sans son consentement, son invention sur le territoire des États membres participants.
(10) The rights conferred by the European patent with unitary effect should enable the patent proprietor to prevent any third party not having his consent from the direct and indirect use of the invention on the territories of the participating Member States.

(15) Les États membres participants devraient confier à l'Office européen des brevets certaines tâches administratives dans le domaine des brevets européens à effet unitaire, notamment la gestion des demandes d'effet unitaire, l'enregistrement de l'effet unitaire et de toute décision de limitation, licence, transfert, révocation ou extinction des brevets européens à effet unitaire, la collecte et la redistribution des taxes annuelles, la publication de traductions purement informatives durant une période de transition et la gestion d'un système de compensation des coûts de traduction pour les demandeurs qui déposent leur demande de brevet européen dans une langue autre que l'une des langues officielles de l'Office européen des brevets.
(15) The participating Member States should give the European Patent Office certain administrative tasks relating to European patents with unitary effect, in particular as regards administration of requests for unitary effect, the registration of unitary effect and of any limitation, licence, transfer, revocation or lapse of European patents with unitary effect, the collection and redistribution of renewal fees, the publication of translations for information purposes during a transitional period and the administration of a compensation scheme of translation costs for applicants filing European patent applications in a language other than one of the official languages of the European Patent Office.
