Lorsque l’inspecteur intervenant au titre du contrôle par l’État du port ne relève pas de l’autorité de sûreté compétente du port définie au paragraphe 7 de l’article 2 du présent règlement, et qu’il estime qu’il existe des raisons sérieuses de penser que le navire ne satisfait pas aux prescriptions des mesures spéciales pour renforcer la sûreté maritime de la Convention SOLAS ou du code ISPS, il en réfère sans délai à cette autorité de sûreté maritime compétente, qui applique alors les mesures prévues aux paragraphes 1.2 et 1.3 de la règle 9 des mesures spéciales pour renforcer la sûreté maritime de la Convention SOLAS.

Where the inspector performing port State control does not belong to the competent authority for port security defined in Article 2(7) of this Regulation and where he believes that there are clear grounds for believing that the ship is not in compliance with the requirements of the special measures to enhance maritime security of the SOLAS Convention and of the ISPS Code, he shall immediately refer the matter to the competent authority for maritime security, which shall take the measures provided for in paragraphs 1.2 and 1.3 of Regulation 9 of the special measures to enhance maritime security of the SOLAS Convention.

2.
