The legal framework of the Community on the rental right and lending right and on certain rights related to copyright can be limited to establishing that Member States provide rights with respect to rental and lending for certain groups of rightholders and further to establishing the rights of fixation, distribution, broadcasting and communication to the public for certain groups of rightholders in the field of related rights protection.

2. Les durées de protection prévues à la présente directive s'appliquent à toutes les œuvres et à tous les objets qui, à la date visée au paragraphe 1, étaient protégés dans au moins un État membre dans le cadre de l'application des dispositions nationales relatives au droit d'auteur ou aux droits voisins ou qui répondent aux critères de protection énoncés dans la directive [92/100/CEE du Conseil du 19 novembre 1992 relative au droit de location et de prêt et à certains droits voisins du droit d'auteur dans le domaine de la propriété intellectuelle] (5).
2. The terms of protection provided for in this Directive shall apply to all works and subject matter which were protected in at least one Member State on the date referred to in paragraph 1, pursuant to national provisions on copyright or related rights, or which meet the criteria for protection under [Council Directive 92/100/EEC of 19 November 1992 on rental right and lending right and on certain rights related to copyright in the field of intellectual property] (5).

I think that is reason enough for us to adopt this Charter, even though there are points at which it may be hard to accept that many rights, many basic rights which Parliament demanded for the people of Europe, and with good cause, have been left out of the Charter.
