2. Union institutions, bodies, offices and agencies and Member State bodies may request advice from the Agency in the event of breach of security or loss of integrity with a significant impact on the operation of networks and services.

En ce qui concerne les organismes ayant l’Agence pour autorité compétente conformément à l’article 21, paragraphe 1, point b), du règlement (CE) no 216/2008:
As regards organisations for which the Agency is the competent authority in accordance with Article 21(1)(b) of Regulation (EC) No 216/2008:

2. L’autorité d’un État membre qui était chargée de superviser la sécurité d’organismes ayant l’Agence pour autorité compétente en vertu de l’article 3, transfère à l’Agence la fonction de supervision de la sécurité de ces organismes 12 mois après la date d’entrée en vigueur du présent règlement, à l’exception de la supervision de la sécurité du gestionnaire de réseau pour laquelle le transfert, le cas échéant, à la Commission, aidée de l’Agence, est effectué à la date d’entrée en vigueur du présent règlement.
2. The authority of a Member State which has had the responsibility for the safety oversight of organisations for which the Agency is the competent authority in accordance with Article 3 shall transfer to the Agency the safety oversight function of these organisations 12 months after the date of entry into force of this Regulation, except in the case of the safety oversight of the Network Manager where the transfer, if any, to the Commission, assisted by the Agency, shall be made on the date of entry into force of this Regulation.

3. Lorsqu’un organisme ayant, conformément à l’article 3, l’Agence pour autorité compétente a introduit une demande de délivrance de certificat auprès d’une autorité nationale de surveillance d’un État membre avant la date d’entrée en vigueur du présent règlement, l’autorité nationale de surveillance finalise le processus de certification en coordination avec l’Agence et transfère le dossier à l’Agence une fois le certificat délivré.
3. Where organisations, for which the competent authority will be the Agency in accordance with Article 3, have applied to a national supervisory authority of a Member State for the issue of a certificate before the date entry into force of this Regulation, the national supervisory authority shall finalise the certification process in coordination with the Agency and transfer the file to the Agency upon the issue of the certificate.

5. L'autorité compétente d'un État membre qui a eu la responsabilité du contrôle de la sécurité d'organismes de formation ayant l'Agence pour autorité compétente en vertu de l'article 4, transfère à l'Agence la fonction du contrôle de la sécurité de ces organismes six mois après la date d'entrée en vigueur du présent règlement.
5. The competent authority of a Member State which has had the responsibility for the safety oversight of training organisations having the Agency as the competent authority in accordance with Article 4 shall transfer the safety oversight function of those organisations to the Agency six months after the date of entry into force of this Regulation.

4. L'autorité compétente d'un État membre à laquelle un organisme de formation, ayant l'Agence pour autorité compétente en vertu de l'article 4, a présenté une demande de délivrance d'homologation avant la date d'entrée en vigueur du présent règlement, mène à son terme le processus d'homologation en coordination avec l'Agence et transfère le dossier à l'Agence à la délivrance de l'homologation.
4. The competent authority of a Member State to which training organisations having the Agency as the competent authority in accordance with Article 4 have applied for the issue of a certificate before the date of entry into force of this Regulation shall finalise the certification process in coordination with the Agency and transfer the file to the Agency upon the issue of the certificate.

3. L'organisme d'audit indépendant donne à la Commission et à ses représentants ainsi qu'à la Cour des comptes accès à l'ensemble des documents et rapports ayant servi à établir l'avis d'audit qu'il émet sur la déclaration annuelle de gestion de l'agence nationale.
3. The independent audit body shall give the Commission and its representatives, as well as the Court of Auditors, full access to all documents and reports in support of the audit opinion that it issues on the national agency's yearly management declaration.

Eu égard aux intérêts en cause (organisateurs d'événements, ayants-droit, agences, organismes de radiodiffusion télévisuelle , public), et compte tenu du fait que certains Etats membres ont déjà adopté des dispositions spécifiques en la matière, dans un souci notamment de pluralisme des sources d'information, il importe d'aborder cette question nouvelle afin d'analyser si l'absence de dispositions au niveau de la Communauté pose des obstacles au marché intérieur.
Bearing in mind the interests at stake (event organisers, rights holders, agencies, television broadcasting bodies, the public) and taking into account the fact that some Member States have already adopted specific provisions on the subject, in the interest of having as broad an information base as possible, this new question should be addressed with a view to analysing whether the absence of Community provisions creates obstacles to the internal market.
