Where a UCITS invests in the units of other UCITS or collective investment undertakings that are managed, directly or by delegation, by the same management company or by any other company with which the management company is linked by common management or control, or by a substantial direct or indirect holding, that management company or other company shall not charge subscription or redemption fees on account of the UCITS’ investment in the units of such other UCITS or collective investment undertakings.

- 2 - Amended proposal for a Directive relating to undertakings for collective investment in transferable securities (UCITS)[2] On a proposal from the Presidency, the Council is called upon to approve without discussion a letter to the Commission asking for an initiative to try to break the deadlock in the discussions between the delegations on this proposal, published in February 1993 and amended in July 1994, which would extend the scope of the existing UCITS Directive (85/611/EEC) so as to include funds investing in other UCITS and money market funds and to enable depositaries to benefit from the freedom to provide services.

Les modifications proposées aujourd'hui incorporent une grande partie des amendements proposés par le Parlement européen portant notamment sur les aspects suivants: 1. l'inclusion dans le champ d'application de la directive des fonds dits "cash-funds", qui investissent 100% de leurs actifs en dépôts bancaires et des "feeder funds", qui investissent leurs actifs entièrement dans un seul OPCVM. 2. pleine liberté serait maintenant donnée aux OPCVM de bénéficier des services d'un dépositaire établi dans un autre Etat membre, sur la base de dispositions garantissant une surveillance efficace, garantissant ainsi la liberté de prestation de services.
The amendments which have been proposed today incorporate a large number of the amendments proposed by Parliament, particularly by: 1. extending the scope of the Directive to include cash funds which invest 100% of their assets in bank deposits, and feeder funds which invest all of their assets in a single Ucit; 2. allowing Ucits full freedom to use the services of a depository authorized in another Member State under provisions which guarantee effective supervision, thereby ensuring freedom to provide services.
