For large investment projects, the Commission can only approve aid without an in-depth formal investigation if the beneficiary's market share and the capacity increase created by the investment do not exceed certain thresholds: the market share must not exceed 25% before or after the investment and the production capacity increase must remain below 5% of the total market in an underperforming market.

Oui, en effet, et je pense que l'aspect « pas très important » de cet investissement est fonction de la taille de l'entreprise: pour une entreprise comme Bell Canada, 2,5 millions de dollars ne représente pas un investissement important, mais pour un type qui doit emprunter cette somme à la banque et qui doit se convaincre que les règles du jeu lui seront favorables et que la concurrence ne va pas le clouer au tapis dès le départ, à mon sens, l'investissement devient assez important.
Yes, I think the “not material” side of it depends on how big you are: $2.5 million to a Bell Canada is not material, but $2.5 million to a guy who has to borrow it from the bank and has to say “We think the rules are going to be okay and we don't think they're going to beat us up when we get there”.It's a material number, at that point.

In its "Communication on certain legal aspects concerning intra-EU investment" (IP/97/477; OJ C220 of 19.7.1997) the Commission specified that, according to EU law, restrictions on the free movement of capital and the right of establishment, such as authorisation procedures for investment in privatised companies, should apply without discrimination, be justified on imperative requirements in the general interest, be suitable for securing the attainment of the objective that they pursue and, finally, must not go beyond what is necessary to achieve the defined objective.

This approach should, without neglecting the various components of development, in particular rural development, involve giving assistance to priority social sectors by contributing to the development of genuine sectoral approaches supported by the allocation of counterpart funds in coherent, transparent, equitable and properly implemented national budgets, and ensuring the effectiveness of public services in those sectors; - to maintaining an adequate level of investment, particularly in areas where the Community concentrates its development activities: adjustment must integrate the long-term perspective; it must create an environment favourable to private investment, and permit a level of public investment compatible at least with the preservation of the infrastructure necessary for economic and social activity; (c) to ensure that, where relevant, programmes are placed in a regional trade facilitation or economic integration framework, and that temporary funding is provided for the transitional costs which may accompany this process, so as to create a dynamic process which transcends the countries' economies alone and thus make it possible, in accordance with Article 130u of the Treaty on European Union, to foster the smooth and gradual integration of the developing countries into a rapidly changing world economy; (d) to work, in close coordination with the multilateral and bilateral providers of funds concerned, towards adjustment of instruments and methods of action so that the Union can adapt to situations as they develop and to their diversity.
