Le requérant est d’avis que l’argument relatif à des contraintes budgétaires de la part du SEAE serait mal fondé étant donné que, si le candidat classé en deuxième position lors de la sélection qui a suivi l’avis de vacance avait été choisi, celui-ci étant fonctionnaire, son traitement mensuel correspondrait à celui d’un fonctionnaire classé au grade AD 13.
The applicant contends that there is no reason to state that the EEAS was under budgetary constraints, since, if the candidate who came second in the selection process that followed the vacancy notice had been selected, his monthly salary would have been that of an official in grade AD 13, because he was an official.

As regards the applicant’s first argument, the Tribunal notes that it is clear, from a simple comparison between the list of the functions to be performed by the temporary agent in grade AD 5 who was to be recruited, as given in the vacancy notice, and the list of functions in the job description for the post occupied by the applicant when he was a seconded national expert, that that argument has no basis in fact.

3.
