B. whereas criminal organisations have gradually extended their operating range on an international scale, exploiting economic globalisation and new technologies, and entering into alliances with criminal groups in other countries (examples being the South American drug cartels and Russian-speaking organised crime) in order to carve up markets and spheres of influence; whereas increasingly criminal groups are diversifying in their operations, with links growing between drug trafficking, the trafficking of human beings, the facilitation of illegal immigration, weapons trafficking, and money laundering;

L. considérant que l'esprit d'entreprise est une des principales caractéristiques des organisations criminelles modernes, dont les formes d'action sont fortement orientées vers la satisfaction de la demande du marché des biens et services, qui coopèrent largement avec d'autres organisations criminelles et non criminelles et qui naviguent perpétuellement entre la dimension apparemment licite de leurs activités, les méthodes de corruption et d'intimidation et les fins illicites visées (par exemple le blanchiment de capitaux);
L. whereas entrepreneurship is one of the main traits of modern criminal organisations, which engage in forms of action geared strongly towards meeting market demand for goods and services and involving intensive cooperation with other operators, criminals or otherwise, and alternate constantly between the apparently lawful dimension of their business and methods of intimidation and corruption and illegal ends (pursued through money laundering, for example);

B. considérant que les organisations criminelles traditionnelles ont progressivement élargi leur champ d'action à l'échelle internationale, en exploitant les possibilités qu'offrent l'ouverture des frontières intérieures de l'Union européenne ainsi que la mondialisation économique et les nouvelles technologies, et en s'alliant à des organisations criminelles originaires d'autres pays (à l'instar des cartels de la drogue sud-américains et de la criminalité organisée russophone) pour se partager les marchés et les zones d'influence; considérant qu'un nombre sans cesse croissant d'organisations criminelles diversifient leurs activités, en renforçant toujours les liens entre le trafic de drogues, la traite des êtres humains, la facilitation de l'immigration irrégulière et le trafic d'armes; considérant que le lien entre le terrorisme et la criminalité organisée devient de plus en plus systématique;
B. whereas traditional criminal organisations have gradually extended their operating range on an international scale, exploiting the opportunities offered by the opening of the internal borders of the European Union, as well as economic globalisation and new technologies, and entering into alliances with criminal groups in other countries (examples being the South American drug cartels and Russian-speaking organised crime) in order to carve up markets and spheres of influence; whereas, increasingly, criminal groups are diversifying in their operations, with links growing between drug trafficking, trafficking in human beings, facilitation of irregular immigration and weapons trafficking; whereas the link between terrorism and organised crime is becoming increasingly organic;

L. considérant que l'extorsion, le racket et l'usure figurent parmi les méthodes permettant aux organisations criminelles d'infiltrer l'économie légale, altérant gravement toute forme de libre marché et réduisant les droits des citoyens, des entrepreneurs, des travailleurs et autres professionnels; que l'étude réalisée en 2008 par Transcrime et financée par la Commission, intitulée «Studio sul racket estorsivo: la necessità di uno strumento per contrastare le attività del crimine organizzato », indique que ce phénomène prend une ampleur alarmante dans au moins la moitié des États membres de l'Union européenne et s'est largement implantée dans l'autre moitié; que la diffusion des pratiques d'extorsion est directement liée à l'étendue de l'emprise des organisations criminelles sur un pays et les activités économiques, commerciales et politiques de ce dernier; que la lutte efficace contre l'extorsion de fonds doit commencer en incitant les victimes à la dénoncer ainsi qu'en assurant une forte présence des autorités officielles sur le territoire;
L. whereas extortion, racketeering and usury are among the ways in which organised criminals infiltrate the legal economy, severely distorting any form of free market and curtailing the rights of citizens, entrepreneurs, workers and professionals; whereas, as was shown by the 2008 Commission-funded Transcrime study entitled ‘Study on Extortion Racketeering: the Need for an Instrument to Combat Activities of Organised Crime’, this phenomenon is assuming alarming proportions in at least half of the EU Member States and exists on a significant scale in the other half; whereas the spread of extortion racketeering stands in a direct relationship to the extent of the control of a country and its economic/business and political activities exercised by organised criminals; whereas the first essential steps to take to combat extortion racketeering effectively are to encourage victims to report offences and to ensure that official authorities maintain a strong presence;

The text defines offences committed by persons taking part in a criminal organisation, covering not only the criminal activities of the organisation as such, but also other acts ranging from the provision of material assistance to a criminal organisation to the recruitment of new members.

Par ailleurs, il est envisagé d’alléger la peine des membres d’organisations criminelles qui coopèrent avec les autorités en vue d’empêcher que des actes criminels aient lieu ou qui les aident à identifier et à traduire en justice d’autres criminels.
The proposal also envisages lowering of the sentence of those members of criminal organisation who cooperate with the authorities with a view to avoiding criminal activities to take place or assist in identifying and bringing to justice other offenders.

The new offences include: criminal harassment, uttering threats, breaking and entering into a place other than a dwelling-house, being unlawfully in a dwelling-house, intimidation, arson – damage to property, arson for a fraudulent purpose, participation in activities of a criminal organization, commission of an offence for a criminal organization, and instructing the commission of an offence for a criminal organization.
