Moreover, as regards the test paper for the version of the subject on which the applicant was examined in the case study, the Tribunal holds that, although according to case-law a document is covered by the secrecy surrounding the proceedings of the selection board where communication of the document is liable to disclose the attitudes adopted by individual members of the selection board or assessments of a personal and comparative nature with regard to the candidates (Konstantopoulou v Court of Justice, paragraph 27), the confidentiality surrounding the proceedings of the selection board does not preclude the confidentiality of a document in a competition procedure being justified on other grounds.

The Commission shall cancel, except in duly justified cases, financial aid granted for studies which have not been started within one year following the start date established in the conditions governing the granting of aid or within two years of that date for all other actions eligible for financial aid under this Regulation.

Objet : Recours, introduit au titre de l’article 270 TFUE, applicable au traité CEEA en vertu de son article 106 bis, par lequel M. Soukup demande, d’une part, l’annulation, en premier lieu, de la décision du jury du concours EPSO/AD/144/09 de ne pas l’inscrire sur la liste de réserve du concours, en deuxième lieu, de la décision du même jury d’inscrire sur ladite liste un autre candidat, en troisième lieu, de « toutes les opérations auxquelles a procédé le jury à partir du stade où sont intervenues les irrégularités dénoncées », et, d’autre part, à la condamnation de la Commission au paiement d’une indemnité de 25 000 euros aux fins de la réparation du préjudice prétendument subi.
Application: brought under Article 270 TFEU, applicable to the EAEC Treaty by virtue of Article 106a thereof, in which Mr Soukup seeks, first, annulment (i) of the decision of the selection board of competition EPSO/AD/144/09 not to enter him on the reserve list for the competition, (ii) of the decision of the same selection board to enter another candidate on that list, (iii) of ‘all the operations carried out by the selection board as from the stage at which the irregularities complained of occurred’ and, secondly, an order for the Commission to pay the sum of EUR 25 000 by way of compensation for the damage allegedly suffered.

Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).
For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
