Calls on the Member States and the Commission to continue their efforts with a view to the effective implementation of the European Arrest Warrant; calls on the Commission to consider whether the grounds for optional non-execution of the European arrest warrant referred to in Article 4 of the framework decision could be redrafted to meet the Union's fundamental rights obligations and in the light of experience gained with subsequent mutual recognition instruments in respect of offences generally associated with organised crime, including the offence of mafia association; calls on the judicial authorities of the Member States to make every effort to ensure that the European arrest warrants they issue are always forwarded to Interpol;

While national governments are solely responsible for detention issues and prison management, it is the European Commission's role to make sure judicial cooperation in the EU works and fundamental rights are respected when EU mutual recognition instruments – such as the European Arrest Warrant – are implemented.

Quatrièmement, Monsieur le Président, je pense que ce résultat est positif pour le Parlement, car nous avons réussi à atteindre une grande partie des objectifs pour lesquels nous nous battions, parmi lesquels j’aimerais souligner les suivants: une gestion communautaire du système central, sous le contrôle démocratique du Parlement européen et le contrôle juridique de la Cour de justice (il est prévu de créer, en codécision avec le Parlement, une agence communautaire dans un délai de cinq ans); une plus grande harmonisation des signalements aux fins de non-admission dans l’espace Schengen contenus dans le système d’information Schengen (SIS) (la Commission est invitée à proposer, dans un délai de trois ans, des initiatives visant à atteindre un niveau plus élevé d’harmonisation); le fait que les mandats d’arrêt européens soient inclus dans le système central du SIS; le fait que les données biométriques ne soient utilisées en tant que critère de recherche qu’après l’élaboration d’un rapport, qui sera présenté au Parlement et sur lequel celui-ci se prononcera; le renforcement des règles relatives à la protection des données et des droits des individus par rapport au système; le renforcement du système de contrôle, au niveau européen comme au niveau national; et l’obligation d’élaborer des rapports afin d’augmenter la transparence du fonctionnement global du système.
Fourthly, Mr President, I feel that this is a good outcome for Parliament, because we have managed to achieve most of what we had been fighting for, of which I should like to highlight the following: Community management of the central system, under the democratic control of the European Parliament and the legal control of the Court of Justice (the creation of a Community agency within five years, established in codecision with Parliament, is provided for); the fact that there is greater harmonisation of alerts in the Schengen Information System (SIS), whereby entry into the Schengen area can be refused (the Commission is invited to submit initiatives, within three years, aimed at achieving higher levels of harmonisation); the fact that European Arrest Warrants are stored in the SIS central system; the fact that we are using biometric data as a research field only after the drafting of a report to be submitted to Parliament on which Parliament will have its say; the fact that we have clearly strengthened the rules on data protection and the rights of individuals in relation to the system, the fact that the supervision system has been strengthened at both European and national level; and the obligation to draw up reports in order to increase transparency regarding the overall functioning of the system.

Le Conseil européen demande que les éléments restants du Plan d'action en faveur des services financiers, à savoir les propositions de directives sur les services d'investissement et sur la transparence, soient définitivement arrêtés avant la fin de la présente législature du Parlement européen.
The European Council calls for the remaining elements of the Financial Services Action Plan the proposed Directives on Investment Services and on Transparency to be finalised before the end of the current Parliament.

45. To this end it has adopted the Decision appended as Annex IV. The incoming Presidency is asked to establish the conditions for the implementation of this Decision by the time of the extraordinary meeting of the European Council in Tampere on 15 and 16 October 1999.
