Il convient de noter à cet égard que, dans l'affaire C-303/05 Advocaten voor de Wereld contre Leden van de Ministerraad, l'avocat général Ruiz-Jarbo Colomer considère dans ses conclusions du 12 septembre 2006 que la décision-cadre sur le mandat d'arrêt européen constitue une disposition d'harmonisation au motif que "les mandats d'arrêt s'inscrivent dans la tradition des codes de procédure pénale nationaux et la décision-cadre les dote, dans certaines circonstances et à certaines conditions, d'effets opérant au-delà des frontières, mais exige à cette fin qu'il y ait concordance entre les régimes nationaux" (point 49).
It is noted in this connection that in his Opinion of 12 September 2006 in Case C-303/05 Advocaten voor de Wereld v. Leden van de Ministerraad, Advocate General Ruiz-Jarabo Colomer considered that the framework decision on the European arrest warrant was a harmonising provision on the ground that "Arrest warrants are well established under the criminal procedure laws of the Member State and, in certain circumstances, subject to specified conditions, the Framework Decision affords them cross-border effect, an objective which requires approximation of the relevant national rules" (para. 49).

1. if, in one of the cases referred to in Article 2(4), the act on which the European arrest warrant is based does not constitute an offence under the law of the executing Member State; however, in relation to taxes or duties, customs and exchange, execution of the European arrest warrant shall not be refused on the ground that the law of the executing Member State does not impose the same kind of tax or duty or does not contain the same type of rules as regards taxes, duties and customs and exchange regulations as the law of the issuing Member State;

(6) Le mandat d'arrêt européen prévu par la présente décision-cadre constitue la première concrétisation, dans le domaine du droit pénal, du principe de reconnaissance mutuelle que le Conseil européen a qualifié de "pierre angulaire" de la coopération judiciaire.
(6) The European arrest warrant provided for in this Framework Decision is the first concrete measure in the field of criminal law implementing the principle of mutual recognition which the European Council referred to as the "cornerstone" of judicial cooperation.

4. For offences other than those covered by paragraph 2, surrender may be subject to the condition that the acts for which the European arrest warrant has been issued constitute an offence under the law of the executing Member State, whatever the constituent elements or however it is described.
