En 2011, après avoir considéré que le Luxembourg n’avait toujours pas exécuté cet arrêt de 2006, étant donné que six stations d’épuration desservant des agglomérations de plus de 10 000 EH n’étaient toujours pas conformes aux prescriptions de la directive, la Commission a introduit ce deuxième recours en manquement. In 2011, having come to the conclusion that Luxembourg had still failed to comply with that judgment of 2006, given that six treatment plants serving agglomerations having a p.e. of more than 10 000 had still not complied with the Directive’s requirements, the Commission brought the present, second set of infringement proceedings, in which it asked the Court to order Luxembourg to pay a penalty payment of €11 340 for each day of delay in complying with the first judgment, from the date of delivery of the judgment in the present case until the date of compliance with the first judgment of 2006, and a daily lump sum of €1 248, from the date of delivery of the first judgment (23 November 2006) until the date of delivery of the judgment in the present case, or until the date upon which the first judgment has been complied with, if earlier.

On the recommendation of Environment Commissioner Janez Potočnik, the Commission is therefore referring Sweden back to the European Court of Justice and, in line with established policy, suggesting a daily penalty payment of € 14 912 for each day after the second Court ruling until Sweden complies with the judgment and a lump sum calculated on the basis of € 4 893 per day for the period between the first judgment and the day of compliance or the day of the second Court ruling.

L'Allemagne ayant omis de prendre toutes les mesures pour se conformer pleinement à l'arrêt de la Cour, la Commission a décidé de saisir une nouvelle fois la Cour de cette affaire, et de lui demander d'imposer une astreinte journalière de 31.114,72 € à l'Allemagne pour la période entre le premier arrêt de la Cour et le moment où ce pays se mettra en conformité avec l'arrêt de 2007 ou, s'il est pris plus tôt, le deuxième arrêt de la Cour, ainsi qu'une astreinte journalière de 282.725,10 € pour la période entre le deuxième arrêt de la Cour et le moment où l'Allemagne aura mis la loi Volkswagen en conformité avec les règles européennes.
Since Germany has failed to take all the necessary measures to fully comply with the Court's judgement, the Commission has now decided to bring the case before the Court again and will ask the Court to impose financial penalties on Germany of € 31 114.72 per day from the date of the initial Court ruling until Germany complies with the 2007 judgement or until the second Court ruling whichever comes first, as well as € 282 725.10 per day from the date of the second Court ruling until Germany has brought the Volkswagen law into line with EU rules.
