In the interest of legal certainty, it is appropriate that this Regulation apply retroactively from 1 January 2012, in order to ensure continuity in the application of the exemption from the requirement to record individual animal codes in the movement document.

La dérogation prévue à l’article 1er s’applique aux longes de thon exportées depuis le Guatemala et déclarées pour la mise en libre pratique dans l’Union, jusqu’à concurrence des quantités figurant à l’annexe du présent règlement et pour la période allant du 1er janvier 2012 au 31 décembre 2013, ou jusqu’à la date d’une application provisoire de l’accord d’association entre l’Union européenne et l’Amérique centrale par le Guatemala si cette date est antérieure».
The derogation provided for in Article 1 shall apply to tuna loins exported from Guatemala and declared for release for free circulation in the Union during the period from 1 January 2012 to 31 December 2013 or until the date of a provisional application of the Association Agreement between the European Union and Central America by Guatemala if this date is the earlier and up to the quantities set out in the Annex to this Regulation’.

From 1 January 2010 until 1 January 2012, it may apply a differentiated rate on commercial use of gas oil used as propellant, provided that it does not result in taxation at below EUR 302 per 1 000 l and that the national levels of taxation in force on 1 January 2010 are not reduced.
