5. En ce qui concerne les produits dérivés négociés, une plate-forme de négociation qui se trouve en-deçà du seuil pertinent pendant l’année civile précédant la mise en application du présent règlement, peut, avant la mise en application du présent règlement, informer l’AEMF et son autorité compétente qu’elle ne souhaite pas être liée par cet article pour les produits dérivés cotés compris dans ce seuil pendant une période de trente mois à compter de la mise en application du présent règlement.
5. As regards exchange-traded derivatives, a trading venue which falls below the relevant threshold in the calendar year preceding the entry into application of this Regulation, may, before the entry into application of this Regulation, notify ESMA and its competent authority that it does not wish to be bound by this Article for exchange-traded derivatives included within that threshold, for a period of thirty months from the application of this Regulation.

3. Les États membres établissent un rapport sur l'application du présent règlement pour chaque année civile complète ou partielle au cours de laquelle il est applicable, selon le modèle prévu à l'annexe II du présent règlement. 3. Member States shall compile a report on the application of this Regulation in respect of each whole or part calendar year during which this Regulation applies, in the form laid down in Annex II. This report may be integrated into the annual report to be submitted by Member States pursuant to Article 21(1) of Council Regulation (EC) No 659/1999 , and shall be submitted by 30 June of the year following the calendar year covered by the report.

2. Lorsqu’une entreprise exerce ses activités à la fois dans un ou plusieurs des secteurs mentionnés au paragraphe 1, points a), b) ou c) et dans un ou plusieurs secteurs entrant dans le champ d’application du présent règlement ou exerce d’autres activités entrant dans le champ d’application du présent règlement, ce dernier s’applique aux aides octroyées pour ces autres secteurs ou activités, à condition que l’État membre concerné veille, par des moyens appropriés, tels que la séparation des activités ou la distinction des coûts, à ce que les activités exercées dans les secteurs exclus du champ d’application du présent règlement ne bénéficient pas d’aides de minimis octroyées conformément au présent règlement.
2. Where an undertaking is active in the sectors referred to in points (a), (b) or (c) of paragraph 1 and is also active in one or more of the sectors or has other activities falling within the scope of this Regulation, this Regulation shall apply to aid granted in respect of the latter sectors or activities, provided that the Member State concerned ensures, by appropriate means such as separation of activities or distinction of costs, that the activities in the sectors excluded from the scope of this Regulation do not benefit from the de minimis aid granted in accordance with this Regulation.

(38) En vue de faciliter la transition jusqu'à la mise en application du présent règlement, les pratiques de marché existant avant l'entrée en vigueur du présent règlement et acceptées par les autorités compétentes conformément au règlement (CE) n° 2273/2003 de la Commission du 22 décembre 2003 portant modalités d'application de la directive 2003/6/CE du Parlement européen et du Conseil en ce qui concerne les dérogations prévues pour les programmes de rachat et la stabilisation d'instruments financiers[31] pour l'application de l'article 1er, paragraphe 2, point a), de la directive 2003/6/CE, peuvent rester applicables jusqu'à un an après la date indiquée pour l'application effective du présent règlement, à condition d'en informer l'Autorité européenne des marchés financiers (AEMF).
(38) In order to facilitate a smooth transition to the entry into application of this Regulation, market practices existing before the entry into force of this Regulation and accepted by competent authorities in accordance with Commission Regulation (EC) No 2273/2003 of 22 December 2003 implementing Directive 2003/6/EC of the European Parliament and of the Council as regards exemptions for buy-back programmes and stabilisation of financial instruments[31] for the purpose of applying point 2(a) of Article 1 of Directive 2003/6/EC, may remain applicable until one year after the date specified for effective application of this Regulation provided that they are notified to ESMA.

The labelling requirements referred to in this Regulation shall not apply to products, the manufacturing process of which has commenced before the date of application of this Regulation, provided that these products are labelled in accordance with the legislation applicable to them before the date of application of this Regulation.

(38) Les denrées alimentaires et les aliments pour animaux relevant du champ d'application du présent règlement qui ont été mis légalement sur le marché communautaire avant la date d'application du présent règlement devraient rester autorisés sur le marché, sous réserve de la transmission par les exploitants à la Commission des informations concernant l'évaluation des risques, les méthodes d'échantillonnage, d'identification et de détection, en tant que de besoin, y compris la transmission des échantillons des denrées alimentaires et aliments pour animaux et leurs échantillons de contrôle, dans un délai de six mois à compter de la date d'application du présent règlement.
(38) Food and feed falling within the scope of this Regulation which have been lawfully placed on the Community market before the date of application of this Regulation should continue to be allowed on the market, subject to the transmission to the Commission by the operators of information concerning the risk assessment, methods for sampling, identification and detection as appropriate, including the transmission of samples of the food and feed and their control samples within six months after the date of application of this Regulation.
