6. note avec inquiétude que, comme dans ses précédents rapports, la Cour des comptes a souligné la nécessité de mettre en place un système de rémunération des services fournis par les autorités des États membres, fondé sur les coûts réellement supportés par ces dernières; déplore qu'aucun progrès n'ait été réalisé dans ce domaine depuis 2009, date à laquelle un nouveau système de paiement avait été présenté au conseil d'administration sans toutefois qu'un accord ne soit dégagé; fait remarquer que l'Agence présentera une nouvelle proposition de nouveau système de paiement au conseil d'administration en mars 2013; reconnaît les efforts réalisés par la direction de l'Agence afin d'encourager le conseil d'administration à prendre une décision pour revoir le système de rémunération des services fournis par les États membres en se basant sur des coûts réels; est pleinement conscient que la lenteur des progrès réalisés est due à l'absence de décision de la part du conseil d'administration; se félicite par conséquent que l'administration de l'Agence ait pris l'initiative de demander davantage de soutien de la Commission à cet égard; invite instamment l'Agence à informer l'autorité de décharge de l'évolution de ce dossier, notamment de l'état d'avancement du nouveau plan d'action et de l'avis du conseil d'administration sur le sujet
6. Notes with concern that as in its previous reports, the Court of Auditors has noted the need to introduce a system of remuneration for services provided by Member States authorities, based on their real costs; regrets that no progress has been made on this issue since 2009, when a proposal for a new payment system was presented to the Management Board but no agreement was reached; notes that the Agency will present a new proposal for a new payment system to the Management Board in March 2013; acknowledges the efforts made by the Agency's executives to encourage a decision by the Management Board to revise the system of remuneration of Member States services based on real costs; is fully aware of the fact that the little progress made is due to the lack of decision taken by the Management Board; welcomes, therefore, the approach by the Agency's administration to call upon the Commission for further assistance in this matter; urges the Agency to inform the discharge authority about the developments on this issue, inter alia on the state of play as regards the new action plan and the Management Board's position on it;

Notes that the curriculum vitae of the management staff and of the members of the scientific committee have been made available on the Agency's website; notes, moreover, that the declarations of interest of the members of the scientific committee have also been made available; underlines that, contrary to the Agency's statement by letter of 15 June 2012, none of the curriculum vitae of the Management Board members is currently available on its website and observes that only a link to their organisation is provided; calls on the Agency, in an effort to promote greater transparency in terms of preventing and combating conflict of interests, to publish on its website the declarations of interest and curriculum vitae of the experts, future guest scientists and members of the Management Board; is of the opinion that such measures would allow the discharge authority and the public to observe their qualifications and to prevent potential conflict of interest;

Takes note of the employment of the Agency's former Executive Director by a consultancy that advises, among others, pharmaceutical companies on developing new medication and reducing the period to their market introduction; stresses that this move casts some doubt on the actual independence of the Agency; notes that Article 16 of the Staff Regulations of Officials of the European Union grants wide discretionary power on the Management Board to allow or forbid this type of employment; notes that after consenting to the future employment of the Agency's former Executive Director, the Management Board eventually decided to set limitations with regards to his new and future professional activities; asks, nevertheless, that the Agency provides the discharge authority, by 30 June 2011, with a report that lists all comparable cases that have occurred since the creation of the Agency and explains thoroughly the Management Board's decision in each case;
