(2) Si, suite à l’application du paragraphe (1), une personne inéligible ou une société sous contrôle étranger acquiert une participation dans un terrain réglementé dont la prise ou l’acquisition serait autrement interdite par le présent règlement, la personne inéligible ou la société sous contrôle étranger doit, dans un délai de trois ans suivant l’acquisition d’une participation dans un terrain réglementé, se défaire de la propriété ou de la propriété utile de cette participation dans un terrain réglementé.
(2) If, as a result of the operation of subsection (1), an ineligible person or foreign controlled corporation acquires an interest in controlled land the taking or acquisition of which would otherwise be prohibited by these Regulations, the ineligible person or foreign controlled corporation shall, within three years of so acquiring the interest in controlled land, divest himself or itself, as the case may be, of the ownership or beneficial ownership of that interest in controlled land.

However, there are three cases in which acquisition of a controlling interest does not constitute a concentration, i.e (a) the acquisition of securities by companies whose normal activities include transactions and dealing in securities; (b) where control is acquired by an office-holder according to the law of a Member State; and (c) where a financial holding company acquires control, provided that this company does not have voting rights.
