(b) González y Díez S.A. refers to the cancellation of the contract with Transportes Peral, when in the letter of 8 November 1999 from Mina la Camocha (the owner of González y Díez S.A.), sent by Spain on 2 December 1999, it is stated that there were no installation closures and that González y Díez S.A. had to invest 232589000 pesetas to operate with its own resources instead of contracting.

(21) Having analysed the accounts of the company González y Díez S.A. for the financial year 1998, the Commission checked that the aid totalling 651908560 pesetas granted to the company to cover the technical costs of closing down extraction installations corresponding to an annual production capacity reduction of 48000 tonnes was entered in the company's accounts as an operational profit.

(11) La Commission considère que les transferts de 600 millions d'ESP et de 100 millions d'ESP de l'entreprise González y Díez SA vers l'entreprise Mina la Camocha SA, respectivement les 29 et 30 décembre 1998, ont pu être effectués grâce aux bénéfices de l'exercice de 1998 de l'entreprise González y Díez SA provenant des aides à la couverture des coûts exceptionnels de fermeture.
(11) The Commission considers that the transfer of ESP 600 million and ESP 100 million by González y Díez SA to Minas la Camocha SA on 29 and 30 December 1998 respectively was made possible by the profits González y Díez SA earned in 1998 from the aid to cover exceptional costs of closure.

(9) À l'issue de l'analyse des comptes de l'entreprise González y Díez SA pour l'exercice 1998, la Commission considère que l'aide à concurrence de 651908560 ESP octroyée à l'entreprise González y Díez SA pour couvrir les coûts techniques de fermeture des installations d'extraction correspondant à une capacité de production annuelle de 48000 tonnes n'a pas été utilisée pour couvrir des coûts qui découlent ou qui ont découlé de la restructuration de l'industrie du charbon, tels qu'ils sont définis à l'annexe de la décision n° 3632/93/CECA.
(9) Having examined the accounts of González y Díez SA for 1998, the Commission considers that the aid totalling ESP 651908560 granted to the company to cover the technical costs of closing down extraction installations corresponding to an annual production capacity of 48000 tonnes was not used to cover the costs that have resulted or result from the restructuring of the coal industry, defined in the Annex to Decision No 3632/93/ECSC.
