The provisional Regulation, in recitals 80 to 82, defined the Union industry and confirmed that three companies were excluded from the definition of the Union industry due to their reliance on imports from the countries concerned, that is to say that they imported significantly more biodiesel from the countries concerned than they produced themselves.

As indicated in the Notice of Initiation, the Commission reassessed the definition of the Union industry, in order to take into account the recommendations of the DSB Reports, suggesting that the EU had acted inconsistently with Article 4.1 of the WTO Anti-Dumping Agreement by excluding from the Union industry definition those producers unwilling to be included in the sample and by considering that the threshold of 25 % enshrined in Article 4(1) of the basic Regulation automatically represented a ‘major proportion’ of the total Union production of the product concerned.
