37 (1) À défaut d’accord, soixante jours après l’intervention du ministre provincial sous le régime du paragraphe 34(2), entre les gouvernements sur le fait que l’approbation ou la désapprobation pourrait indûment retarder l’autosuffisance ou la sécurité des approvisionnements, le constat est rendu par un comité de trois arbitres constitué conformément au paragraphe (2) dans les quarante-cinq jours qui suivent la nomination du président du comité.
37 (1) Where, within sixty days after an approval or disapproval by the Provincial Minister pursuant to subsection 34(2), the two governments fail to agree whether the approval or disapproval would unreasonably delay the attainment of self-sufficiency or security of supply, that determination shall be made by a panel consisting of three members constituted in accordance with subsection (2), within forty-five days after the appointment of the chairman of the panel.

(2) À défaut d’accord trois mois après le début des consultations, le constat est rendu par un comité formé de trois arbitres, constitué conformément aux paragraphes 12(3) et (4), dans les soixante jours qui suivent la nomination du président du comité. (2) Where the two governments fail to agree on a determination referred to in subsection (1) within three months after the commencement of consultation between the governments, the determination shall be made by a panel consisting of three members, constituted in accordance with subsections 12(3) and (4), within sixty days after the appointment of the chairman of the panel unless, at any time prior thereto, the two governments agree on the determination.

36. Le surintendant peut révoquer l’agrément du régime et annuler le certificat correspondant si l’administrateur ne se conforme pas à la directive visée aux articles 34 ou 35 dans les soixante jours suivant la notification, par le surintendant, du défaut ou dans tout délai supérieur qu’il peut accorder; il informe l’administrateur, le cas échéant, des mesures prises ainsi que de la date de la révocation et de l’annulation.
36. If the administrator of a pooled registered pension plan does not comply with a direction under section 34 or 35, the Superintendent may — at least 60 days after the day on which the administrator is notified of the failure to comply with the direction — revoke the registration and cancel the certificate of registration in respect of the plan. In that case, the Superintendent must notify the administrator of the measures taken, including the date of the revocation and cancellation.

(5) L'accord, le protocole d'entente ou l'arrangement que le ministre n'approuve ni ne rejette dans le délai de soixante jours prévu au paragraphe (3) entre en vigueur à la date qui y est précisée ou, à défaut, à l'expiration de ce délai.
(5) If the Minister does not approve or reject the agreement, memorandum of understanding or arrangement within the sixty-day period described in subsection (3), it comes into effect on the date specified in it or, if no date is specified, upon the expiry of that sixty-day period.
