Je crois que le problème vient du fait que, bien souvent, lorsque l'accusé se retrouve devant le tribunal, au moment de prendre une décision, il n'a peut-être pas été considéré comme une personne non criminellement responsable — j'utilise cette expression; bien évidemment, il n'a pas été déclaré tel par le tribunal — l'on pourrait dire qu'en tant que personne NCR, l'accusé prenait peut-être des médicaments et il se pourrait que, si celui-ci avait commis l'acte pour lequel il est accusé, il ne serait peut-être pas déclaré NCR parce qu'il avait pris ses médicaments.
I think the difficulty is often by the time we end up before the court, at that decision-making point, an individual who may have been seen as NCR — I'll use that term; obviously, they haven't been designated by the court — or could be argued as NCR may be on their medication and may then be in a position where if they committed the act for which they're accused right then, they might not be found NCR because they were on their medication.
