IN-CONTEXT TRANSLATIONS

Afin d'assurer des conditions uniformes d'exécution du présent règlement, il convient de conférer des compétences d'exécution à la Commission afin: de préciser le modèle et le code applicables aux exigences communes en matière de données régissant l'échange d'informations entre les autorités douanières et entre les opérateurs économiques et les autorités douanières ainsi que le stockage de ces informations et les règles de procédure relatives à l'échange et au stockage d'informations pouvant être effectués par des moyens autres que les procédés informatiques de traitement des données; d'adopter les décisions autorisant un ou plusieurs États membres à utiliser des moyens d'échange et de stockage d'informations autres que les techniques électroniques de traitement des données; de préciser l'autorité douanière responsable de l'enregistrement des opérateurs économiques et des autres personnes; de préciser les dispositions techniques aux fins de la conception, du fonctionnement et de l'exploitation des systèmes électroniques; de préciser les règles de procédure relatives à l'octroi à un représentant en douane de l'autorisation de fournir des services dans un État membre autre que celui de son établissement et à la preuve de cette autorisation; les règles de procédure relatives à la présentation et à l'acceptation d'une demande relative à une décision sur l'application de la législation douanière, à la prise d'une telle décision et au suivi de celle-ci; les règles de procédure relatives à l'annulation, à la révocation ou à la modification d'une décision favorable; les règles de procédure relatives à l'utilisation d'une décision en matière de renseignements contraignants après l'expiration ou la révocation de celle ci; les règles de procédure relatives à la notification aux autorités douanières de la suspension d'une telle décision et au retrait d'une telle suspension; de prendre des décisions demandant aux États membres de révoquer une décision en matière de rens ...
In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission in order: to specify the format and code of the common data requirements for the purpose of the exchange of information between the customs authorities and between economic operators and customs authorities and the storage of such information and the procedural rules on the exchange and storage of information which can be made by means other than electronic data-processing techniques; to adopt decisions allowing one or several Member States to use means for the exchange and storage of information other than electronic data-processing techniques; to specify the customs authority which is responsible for the registration of economic operators and of other persons; to specify the technical arrangements for developing, maintaining and employing electronic systems; to specify the procedural rules on the conferral and proving of the entitlement for a customs representative to provide services in a Member State other than the one where he or she is established; the procedural rules on the submission and acceptance of an application for a decision relating to the application of the customs legislation, and on the taking and the monitoring of such a decision; the procedural rules on the annulment, revocation and amendment of favourable decisions; the procedural rules on the use of a decision relating to binding information after it ceases to be valid or is revoked; the procedural rules on the notification to the customs authorities that the taking of such decisions is suspended and on the withdrawal of such suspension; to adopt decisions requesting Member States to revoke decisions relating to binding information; to adopt the modalities for the application of the criteria for the granting of the status of authorised economic operator; to adopt measures to ensure uniform application of customs controls, including the exchange o ...

Les autorités douanières arrêtent, après introduction d'une demande, des décisions en matière de renseignements tarifaires contraignants, (décisions RTC), des décisions en matière de renseignements contraignants en matière d'origine (décisions RCO) et des décisions en matière de renseignements contraignants relatifs à la valeur en douane (RCVD).
(1) The customs authorities shall, upon application, take decisions relating to binding tariff information (BTI decisions), decisions relating to binding origin information (BOI decisions) and decisions on binding information on the customs value of goods (‘BVI’ decisions).

When a decision relating to a protection measure falls within the scope of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (5), Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility (6), or the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children (7), the recognition and enforcement of that decision should be carried out in accordance with the provisions of the relevant legal instrument.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

Conformément à l’article 4 de l’accord du 19 octobre 2005 entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale (1) (ci-après, «l’accord»), conclu par la décision 2006/325/CE du Conseil (2), lorsque des dispositions d’exécution sont adoptées en vertu de l’article 74, paragraphe 2, du règlement (CE) no 44/2001 du Conseil du 22 décembre 2000 concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale (3), le Danemark notifie à la Commission sa décision d’appliquer ou non le contenu de ces dispositions.
According to Article 4 of the Agreement of 19 October 2005 between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (1) (hereinafter ‘the Agreement’), concluded by Council Decision 2006/325/EC (2), whenever implementing measures are adopted pursuant to Article 74(2) of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (3), Denmark’s decision on whether or not to implement the content of such measures shall be notified to the Commission.

(10 bis) Le réseau judiciaire européen en matière civile et commerciale facilite et contribue à la mise en oeuvre du règlement (CE) nº44/2001 du Conseil, du 22 décembre 2000, concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale et le règlement (CE) nº 1347/2000 du Conseil, du 29 mai 2000, relatif à la compétence, la reconnaissance et l'exécution des décisions en matière matrimoniale et en matière de responsabilité parentale des enfants communs .
(10a) The European Judicial Network in civil and commercial matters supports and facilitates the application of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters and Council Regulation (EC) No 1347/2000 of 29 May 2000 on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and in matters of parental responsibility for children of both spouses .

Par ailleurs, s'agissant de la reconnaissance mutuelle des décisions judiciaires en matière civile, un programme a été adopté. Il a pour socle les Règlements Bruxelles I et II (ces règlements portent sur la reconnaissance et l'exécution des décisions en matière civile et commerciale ainsi qu'en matière de droit de la famille); il vise, à terme, à supprimer l'« exequatur » pour toutes décisions en matière civile et commerciale.
As regards the mutual recognition of judicial decisions in civil matters, a programme has been adopted which is based on the Brussels I and II Regulations (these Regulations deal with the recognition and enforcement of judgments in civil and commercial matters and in family law matters respectively); it is designed, in the long term, to abolish the "exequatur" requirement for enforcing decisions in civil and commercial matters in another Member State.
